The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he would like his overseas service added to his DD Form 214. It was considered a hardship tour of duty in Korea and would appreciate having this service recognized. He would like his service at Fort Gillem, GA, his rank at that time, as well as anything else that needs updating. 3. The applicant enlisted in the Regular Army on 17 June 1960. He was honorably discharged on 18 June 1963. His DD Form 214 shows: * Item 3.a. (Grade, Rate or Rank) shows Private, E-2 * Item 12. (Last Duty Assignment and Major Command) shows Company A, 1st Battalion (Mechanized) 58th Infantry, 3rd US Army * Item 24.a.(1) (Net Service this Period) shows 3 years 0 months 0 days * Item 24.c. (Foreign and/or Sea Service) shows 1 year 3 months 23 days * Item 26. (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) shows Letter of Appreciation, Letter of Commendation, and Rifle Sharpshooter Badge 4. The applicant’s official military personnel file (OMPF) is incomplete and does not contain information concerning his initial period of service. 5. The applicant enlisted in the United States Army Reserve on 2 August 1975 for a period of 1 year. 6. His DA Form 2-1 (Personnel Record Brief) shows the applicant was assigned to Forest Park, GA effective 2 August 1975, and was transferred to Fort Gillem, GA effective 6 October 1975. 7. He reenlisted in the U.S. Army Reserve on 1 August 1977 for a period of 2 years. He remained assigned to Fort Gillem, GA. His DA Form 2-1 shows his rank as sergeant effective 13 June 1977. 8. Orders 55-1, shows the applicant was relieved from the U.S. Army Reserve for personal hardship, and transferred to the inactive reserve effective 17 February 1979. 9. Orders 01-1006891 show the applicant was honorably discharge from the inactive reserve on 31 July 1979. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The applicant served on active duty from 17 June 1960 to 18 June 1963. His DD Form 214 captures his foreign service in Item 24c (Foreign and/or Sea Service) of 1 year 3 months 23 days. As this was a permanent change of station vice a deployment to combat zone, the foreign service is correctly captured in the appropriate block of the DD Form 214. Additionally, there is no evidence he served at Fort Gillem, GA or was promoted to E-5 during the period covered by the DD Form 214. This service and/or promotion occurred while in a Reserve status on or about 6 October 1975 and 13 June 1977 respectively. There is no provision to enter such Reserve service or Reserve grade on a previously-issued DD Form 214. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents) prescribes the separation documents that will be furnished each individual who is separated from the Army, including ACDUTRA personnel, and establish standardized procedures for the preparation and distribution of these documents. For Soldiers of the Reserve Component, a DD Form 214 is issued after completing a period of active service of 90 days or more. a. Section III (Instructions for the Preparation and Distribution of the Armed Forces of the United States Report of Transfer or Discharge (DD Form 214)) states: (1) Item 3a. Enter grade in which serving at time of separation, indicating whether permanent or temporary. Pay grades will also be shown. (2) Item 12. Enter the last unit, or similar element, to which assigned for duty rather than the element of which the individual was a part while moving to a transfer processing activity. The title and/or number of the organization will be precisely as indicated in the DA Form 20 or DA Form·66. (3) Item 24.c.
