The applicant did not file within the three-year period provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in his two applications, in effect: a. His midwife had his DOB as annotated on his military records. When he turned 62-years-old, the Social Security Administration stated, according to their records his DOB was not as shown on his military records. In 2007, his DOB changed to the date shown on his identification card. Although his social security numbers match his DOB does not and the military does not know who he is now. b. He served on the demilitarization zone (DMZ) while he was in Korea. He drew combat and flight pay. A number of his military associates were exposed to Agent Orange that had been applied to thick foliage on the DMZ. He has and is still suffering from a number of symptoms from the Agent Orange. The applicant's service records contain the following documents, none of which shows his DOB as shown on the identification card(s) submitted in support of his application. . Army Regulation 635-5 (Separation Documents) directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board agreed that there was insufficient evidence to change the DOB on his DD Form 214. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created, unless there is sufficient evidence that shows a material error or injustice. The evidence of record shows the applicant used the contested DOB during his entire period of service. For that reason, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. The applicant is advised that a copy of this decisional document will be filed in his official military personnel file. This should serve to clarify any questions or confusion about the difference in the date of birth recorded in his military records and the date of birth on the documents he provided. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the policy for preparing and distributing the DD Form 214.
