IN THE CASE OF: BOARD DATE: 18 May 2022 DOCKET NUMBER: AR20210017671 APPLICANT REQUESTS: in effect, retirement point credit for IDT (Inactive Duty Training) performed in October 2020. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * 2 DA Form 1380 (Record of Individual Performance of Reserve Duty Training) * 2 Memorandum, Subject: Delinquent Retirement Points Credit FACTS: 1. The applicant states, he need to have his DA Form 1380 from October 2020 processed and the reserve points added to his record. The form has not been processed after multiple submissions. It was initially submitted on time and he was told there were administrative errors that needed to be corrected. He corrected the errors and resubmitted the DA Form 1380 in March 2021. He recently received a response from that submission that stated it was submitted too late that he must contact ABCMR to process the correction. He has responded quickly each time he received notification that there was an error but still has had difficulty getting the form processed despite support from his command. 2. The applicant provides: a. A reconstructed DA Form 1380 dated: * 3 March 2020, for interviews, earned in the U.S. Army Reserve on 31 October 2020, for points only; the form was unsigned * 31 October 2020, for interviews, earned in the U.S. Army Reserve on 31 October 2020, for points only; the form was signed on 7 December 2020 b. Memorandum, Subject: Delinquent Retirement Points Credit, dated 31 March 2021, shows the United States Military Academy (USMA) Directorate of Admissions requested the crediting of the reserve retirement points, 3, to the applicant’s reserve record for October 2020. The justification was that the applicant submitted the DA Form 1380 but had errors in formatting. He resubmitted the form with the corrections, but the resubmission was after the submission deadline. He did not receive notification that anything further was required, but the points were not uploaded into his HRC record. As a result, he resubmitted the hours for the referenced period. c. Memorandum, Subject: Delinquent Retirement Points Credit, dated 17 August 2021, shows the USMA Directorate of Admissions requested the crediting of the reserve retirement points, 3, to the applicant’s reserve record for October 2020. The justification was that the applicant submitted the DA Form 1380 in early November 2020 but had errors in formatting. He was notified in March that there were formatting errors and requested to resubmit. He resubmitted the form with the corrections, and was recently notified that since the form was received late that it now needed to be sent to ABCMR for processing. 3. A review of the applicant's service record shows: a. He executed an oath of office on 27 May 2000 and was appointed as a Reserve commissioned officer of the Army. He entered active duty on 27 May 2000. b. He was honorably released from active duty (REFRAD) on 26 July 2000 and transferred to the United States Army Reserve (USAR). His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows he completed 2 months of active service. He was released to attend medical school. c. He was appointed in the USAR on 29 March 2004 as a reserve commissioned officer. He served in a variety of stateside assignments. d. He entered active duty on 8 June 2004. He was honorably REFRAD on 30 April 2019 and transferred to the USAR Control Group (Individual Ready Reserve). His DD Form 214 shows he completed 14 years, 10 months, and 23 days of active service. e. He was again appointed in the USAR on 1 May 2019 as s a reserve commissioned officer. f. Orders C-07-90, dated 16 July 2019, U.S. Army Human Resources Command, Fort Knox, KY, attached him to Headquarters, USMA Staff and faculty with an effective date of 16 July 2016 for an indefinite period for the purpose of training / points only. 4. By regulation (AR 135-185), paragraph 3-3 states DA Form 1380 will be prepared for a unit Soldier who performs ET (Equivalent Training) or additional training with their unit subsequent to the scheduled BA (Battle Assembly). TPU (Troop Program Unit) units will retain one copy of the DA Form 1380 to post the appropriate entry into ADARS (Automated Drill Attendance Reporting Software) for the month’s report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month. DA Form 1380 will be scanned into the Soldier’s iPERMS by the unit of assignment. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board determined there were administrative errors and the applicant in good faith every attempt to submits the points earned. Evidence show the applicant submits his signed DA Form 1380 for 3 points. Based on this the Board granted relief for retirement point credit for IDT (Inactive Duty Training) performed in October 2020. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected to show three (3) retirement point credit for IDT (Inactive Duty Training) performed in October 2020. REFERENCES: Army Regulation (AR) 135-185 Army Reserve Training and Retirement Point Credits and Unit Level Strength Accounting Records, sets responsibilities and procedures to establish and maintain retirement records prescribing the types of training and activities for which retirement points are authorized. It discusses the procedures for recording retirement point credits and training. It provides guidance for the use of completing the DA Form 1379 (U.S. Army Reserve Components Unit Record of Reserve Training) and DA Form 1380 (Army Reserve Record of Individual Performance of Reserve Duty Training). a. Paragraph 3-3(a), the purpose of the DA Form 1380 is to record IDT (Inactive Duty Training) by— (1) TPU (Troop Program Unit) Soldiers performing IDT assemblies when pay is authorized, and the Soldier is not present to sign the IDT attendance roster. (2) TPU Soldiers attached to another USAR unit for 89 or fewer days. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3) Non-unit Soldiers under the jurisdiction of HRC (U.S. Army Human Resources Command) who are attached for retirement points only to USAR TPUs, ARNG units, or to another Service or component for training. Only attached Soldiers are authorized to perform IDT with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. Note: Non-unit Soldiers attached for retirement point credit to IMA (Individual Mobilization Augmentee) detachments are reported on DA Form 1379 for those units. (4) Non-unit Soldiers performing other inactive duty training for retirement point credit as outlined in table 2–3. b. Paragraph 3-3(b), the DA Form 1380 will be prepared for a unit Soldier who performs ET (Equivalent Training) or additional training with their unit subsequent to the scheduled BA (Battle Assembly).
