The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he is requesting the date of entry on his DD Form 214 be corrected to reflect his actual date of entry into service. He believes he is missing the front page of his DD Form 214. He was told that the information would be corrected; however, "they” keep sending him back the same information without the front page. 3. The applicant provides: a. Two SF 180 wherein the applicant is requesting his DD Form 214 for his period of service from 1967 to 1975, in addition to his personnel file, and that it be sent to his Veterans Services Offer (VSO). The applicant states he was Active Army and Missouri Army National Guard (MOARNG). b. SO Number 142, dated 27 June 1975, directed personnel actions for three Soldiers, none of which appear to be the applicant. c. A VA letter, dated 2 March 2020, informed the applicant his active duty training did not meet eligibility, under current law, for VA health care benefits. d. A VA Statement of the Case, dated 6 March 2020, shows the applicant requested service connection for his left eye condition. e. A SF 600, dated 19 May 1975, identified a trainee screening for the applicant’s vision. f. The applicant provided an additional SF 180, dated 20 April 2021, wherein the applicant is requesting his DD Forms 214 for his periods of service for 1967, 1980, and his medical records for the purpose of VA benefits. He annotated his active Army time from 28 June 1967 to 31 August 1973 and his ARNG time from 22 June 1975 to 8 September 1980. g. A DD Form 214 shows the applicant entered active duty on 16 May 1975. He was honorably released from active duty on 27 June 1975. Block 27 (Remarks) indicated the applicant was attached from the MOARNG to complete 18 weeks of active duty training. An additional note shows “Trainee Discharge Program.” He completed 1 month and 12 days of active service with 3 months and 11 days of prior inactive service. h. Three letters from VA: * 6 March 2020 - Statement of the Case included with guidance on appealing his VA decision * 17 November 2020 – the applicant’s request could not be processed because it was incomplete * 7 July 2021 – the VA provided the records the applicant requested i. The applicant was awarded the American Legion Certificate of Honor, dated 20 January 2018, in recognition of his service in the U.S. Armed Forces during the Vietnam War. j. A Commemoration of the 50th Anniversary of the Vietnam, Proclamation, whereby the President proclaimed 28 May 2012 through 11 November 2025 as the period of commemoration, a 13 year program to honor and give thanks to a generation of proud Americans who served the country through one of the most challenging missions ever faced. 4. The applicant's military records are not available to the Board for review. 5. By regulation (AR 635-5), states the DD Form 214 is a summary of the Soldier's record of military service. The DA Form 20 (Enlisted Qualification Record) and the DA Form 66 (Officer Qualification Record) are the basic source documents; however, personnel officers should review all available documents. The information entered thereon reflects the conditions as they existed at the time of separation. Block 15 (Date Entered Active Duty This Period), enter the date in order shows on the DD Form 214, using all numerals; e.g., 73 for year, 01 for January. BOARD DISCUSSION: After reviewing the application, all supporting documents and the evidence found within the military record, the Board determined that relief was not warranted. The Board carefully considered applicant’s contentions, military record, and regulatory guidance. The Board reviewed the applicant’s DD214 which reflects he was in trainee status from 16 May 1975 to 27 June 1975. The documentation available for review is void of further evidence of any additional period of active duty prior to the time of separation. Based on the preponderance of evidence available for review, the Board determined the evidence presented insufficient to warrant a recommendation for relief.
