The applicant states he was paid for a RST DA Form 1380 for 12 and 13 December 2020 but was not awarded points for those days. No points awarded for 12 and 13 December on his points detail on the U.S. Army Human Resources Command website. He provides: * DA Form 1380, dated 15 December 2020, for training earned in the U.S. Army Reserve on 12 and 13 December 2020. The form was signed by his commander on 15 December 2020. * Leave and Earnings Statements for the periods 6 and 10 January 2020 * HRC points printout [TST is training placed on the unit training schedule for subsections of the unit or for individuals at a time, date, and location other than the regularly scheduled training assembly. Pay and retirement point credit are authorized. RST policy provides guidance for unit members on steps to take when they are unable to attend Battle Assembly and wish to request an alternate date, site, or an excused absence]. 2. Review of the applicant's service records shows: a. Having had prior Regular Army commissioned officer service (29 November 2001 to 12 July 2012), he was appointed as a Reserve commissioned officer on 2 July 2012. b. He served in a variety of assignments and he attained the rank/grade of lieutenant colonel (LTC). c. He submitted a DA Form 1380, signed on 15 December 2020 to the U.S. Army Human Resources Command (HRC), claiming retirement points for RST on 12 and 13 December 2020. d. HRC returned his form for correction and informed his unit administrator once that document has been corrected, returned and processed, the points total will be adjusted at that time. e. The applicant's DA Form 5016 (Chronological Statement of Retirement Points) shows he received 106 retirement points for Anniversary Year 1 June 2020 to 31 May 2021. 3. An advisory opinion was received from the Office of the U.S. Army Reserve Command (USARC) at Fort Bragg, NC on 19 April 2022. An advisory official stated in reviewing the applicant's Retirement Points Detail, USARC determined he was paid for the period 12-13 December 2020 but he was not awarded retirement points. USARC recommends awarding the applicant the missing retirement points for 12-13 December 2020. 4. The applicant was provided with a copy of this advisory opinion to give him an opportunity to submit a response. He did not respond. 5. By regulation (AR 135-185), Rule 1, when the individual attends Battle Assembly or RST for pay points, and the individual is in the Selected Reserve, then the individual will be awarded points under the 4-hour rule (maximum of 8 hours for two per day). BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board found that, due to improper processing his DA Form 1380, the applicant was deprived of retirement point credit for duties he performed. The Board determined that, as a matter of equity, the applicant’s record should be corrected by adding retirement pointa for RST (Rescheduled Training) performed on 12 and 13 December 2020. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he completed a paid DA Form 1380, showing rule 1, and it was forwarded to HRC in a timely manner meeting submission timelines for consideration. HRC will determine the appropriate amount of credit as a result of this correction. REFERENCES: Army Regulation 135-185 Army Reserve Training and Retirement Point Credits and Unit Level Strength Accounting Records, sets responsibilities and procedures to establish and maintain retirement records prescribing the types of training and activities for which retirement points are authorized. It discusses the procedures for recording retirement point credits and training. It provides guidance for the use of completing the DA Form 1379 (U.S. Army Reserve Components Unit Record of Reserve Training) and DA Form 1380 (Army Reserve Record of Individual Performance of Reserve Duty Training). a. Paragraph 3-3(a), the purpose of the DA Form 1380 is to record IDT (Inactive Duty Training) by— (1) TPU (Troop Program Unit) Soldiers performing IDT assemblies when pay is authorized, and the Soldier is not present to sign the IDT attendance roster. (2) TPU Soldiers attached to another USAR unit for 89 or fewer days. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3) Non-unit Soldiers under the jurisdiction of HRC (U.S. Army Human Resources Command) who are attached for retirement points only to USAR TPUs, ARNG units, or to another Service or component for training. Only attached Soldiers are authorized to perform IDT with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. Note: Non-unit Soldiers attached for retirement point credit to IMA (Individual Mobilization Augmentee) detachments are reported on DA Form 1379 for those units. (4) Non-unit Soldiers performing other inactive duty training for retirement point credit as outlined in table 2–3. b. Paragraph 3-3(b), the DA Form 1380 will be prepared for a unit Soldier who performs ET (Equivalent Training) or additional training with their unit subsequent to the scheduled BA (Battle Assembly). TPU (Troop Program Unit) units will retain one copy of the DA Form 1380 to post the appropriate entry into ADARS (Automated Drill Attendance Reporting Software) for the month’s report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month. DA Form 1380 will be scanned into the Soldier’s iPERMS by the unit of assignment. c.
