The applicant states, in effect, the date on her Reserve Component separation orders should show 5 November 1995. 2. She provided copies of her DD Form 4, her separation orders, and her DJMS-RC MMPA) Data Sheets for 1995 and 1996. 3. On 6 November 1987, the applicant enlisted in the U.S. Army Reserve (USAR) for a period of 8 years. As part of her enlistment she understood that following initial active duty training (IADT) she would be obligated to perform satisfactorily participation in the Ready Reserve for a period of 8 years (DA Form 3540/2-Annex A). 4. On 7 June 1988, she entered active duty for the purpose of IADT. 5. On 21 October 1988, she was released from IADT, she was transferred to control of the USAR, and she was assigned to 344th General Hospital, Fort Totten. 6. A FLAG was initiated on 6 May 1995 and subsequently transferred on 12 December 1995 for APFT failure. 7. Her DA Form 2-1 (Personnel Qualification Record – Part II) shows in item 27 (Remarks) she was retained beyond normal discharge date for the convenience of the government. 8. Orders 265-8, issued by HQ, USAR Regional Support Command, 23 February 1996, honorably discharged her from the USAR, effective 23 February 1996. 9. Her DFAS DJMS-RC MMPA Data Sheets for 1995 and 1996 show her ETS as 5 November 1995. 10. Her DA Form 5016 shows: * 51 retirement points for retirement year ending 5 November 1995 * 5 membership retirement points earned for the period 6 November 1995 to 23 February 1996 * She had broken time beginning 24 February 1996 to 6 June 2013 until her commission as a Reserve officer BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board determined there was insufficient evidence to warrant correction of her Reserve orders to show her expiration term of service (ETS) as 5 November 1995. Evidence in the record currently shows her ETS as 5 November 1995. Based on this, the Board denied relief. Chapter 11-1 Completion of terms of enlistment or period of statutory obligated service. a. The period of military service required for all enlisted Soldiers of the Army will be in accordance with applicable laws. Periods for which enlistment or reenlistment is authorized are set forth in AR 140-111, NGR 600-200, and AR 601-210. On expiration of term of enlistment, reenlistment, or period of statutorily obligated service, the enlisted soldier will be discharged by the separation authority. b. A Soldier retired under the provision of 10 USC 3914.may be discharged from the Retired Reserve at the Solder's request and on completion of 30 years' active and inactive service. c. No Soldier may be held in service beyond the normal expiration of term of service unless expiration of term of service is extended by law.
