He is unable to receive Department of Veterans Affairs benefits.3.His Social Security Card shows his social security number as .4.He enlisted in the U.S. Army Reserve on 12 February 1964, for a period of 6 years. 5.His Reserve Component Service Agreement, 13 February 1964, shows he understands his military service obligation, active duty for training, and his service in the Ready Reserve.6.Headquarters, 16th U.S. Army Corps Letter Orders 3-266, 23 March 1964, ordered him to active duty for training.7.His Certificate of Training, 27 August 1964, shows his successful completion of the Field Communication Crewman Course at Fort Leonard Wood, Missouri.8.He was honorably released from active duty for training and transferred back to his U.S. Army Reserve unit on 29 August 1964. His DD Form 214 shows in:•item 19c (Date of Entry) – 28 March 1964•item 24a(1) (Net Service This Period) – 5 months, 2 days•item 24a(2) (Other Service) – 1 month, 16 days•item 32 (Remarks) – in part, his social security number as , (Note: handwritten correction to show )9.The Headquarters, 16th U.S. Army Corps Letter Orders 2-488, 23 June 1965, with roster, shows his unit was ordered to active duty for training effective 11 July 1965, for the purpose of participating in annual active duty for training. Upon completion of annual active duty for training, unit and assigned members will return to home station and revert to inactive status no later than 24 July 1965.10.His DA Form 20 (Enlisted Qualification Record) shows no additional periods of active duty of greater than 90 days, for the issuance of a DD Form 214. after his release from active duty for training on 29 August 1964.11.The Headquarters, 5th U.S. Army Letter Orders 03-2653, 17 March 1970, honorably discharged him from the U.S. Army Reserve on 17 March 1970. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that partial relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board agreed evidence of record shows the SSN on his DD Form 214 was erroneously listed. However, the date of released is correct as the DD Form 214 shows when the period of active duty ended. 2.Prior to closing the case, the Board did note the analyst of record administrativenotes below, and recommended the correction is completed to more accurately depictthe military service of the applicant. ADMINISTRATIVE NOTE(S): The applicant is authorized correction of his DD Form 214 by adding the National Defense Service Medal REFERENCES: 1.Title 10, U.S. Code, section 1552(b), provides that applications for correction ofmilitary records must be filed within 3 years after discovery of the alleged error orinjustice. This provision of law also allows the ABCMR to excuse an applicant's failure totimely file within the 3-year statute of limitations if the ABCMR determines it would be inthe interest of justice to do so. 2.Army Regulation 15-185 (Army Board for Correction of Military Records) prescribesthe policies and procedures for correction of military records by the Secretary of theArmy acting through the ABCMR. The ABCMR begins its consideration of each casewith the presumption of administrative regularity. The applicant has the burden ofproving an error or injustice by a preponderance of the evidence. 3.Army Regulation 635-5 (Separation Documents), 13 August 1963, prescribed theseparation documents that were furnished each individual who was separated form theArmy, including Active Duty for Training personnel, and established standardizedprocedures for the preparation and distribution of these documents. A DD Form 214was issued at the time of separation, regardless of the actual number of days served, toeach member of the Regular Army and Reserve Components called or ordered to activeduty or Active Duty for Training for a period of 90 days or more. 4.Army Regulation 600-8-22 (Military Awards) prescribes Department of the Armypolicy, criteria, and administrative instructions concerning individual and unit militaryawards. Paragraph 2-11 (National Defense Service Medal) states the National DefenseService Medal may be awarded for both Active and Reserve service and is awarded forhonorable active service for specified periods, to include 1 January 1961 to 14 August1974 (Vietnam). //NOTHING FOLLOWS//
