IN THE CASE OF: BOARD DATE: 5 October 2022 DOCKET NUMBER: AR20220001753 APPLICANT REQUESTS: correction of DA Form 3286 (Statement for Enlistment United States Army Enlistment Program) (Annex B) to qualify him for payment of his enlistment bonus in the amount of $8,000.00. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DA Form 3286 (Annex A) (Statement for Enlistment U. S. Army Enlistment Program U. S. Army Delayed Entry Program) * DA Form 3286 (Annex B) (Statement for Enlistment U. S. Army Enlistment Program) FACTS: 1. The applicant states in effect, he requests to be paid his enlistment bonus in the amount of $8,000.00 for which he contracted when he enlisted in the Regular Army (RA). His bonus could not be paid due to DA Form 3286 (Annex B) not containing option 173 for the $8,000.00 cash bonus; however, DA Form 3286 (Annex A) does contain this data. Unless both documents contain this data, the finance office cannot process his bonus. 2. A review of the applicant's service record shows: a. The applicant enlisted in the U.S. Army Reserve (USAR) delayed entry program (DEP) on 30 October 2020. DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States), page 4, section F (Discharge from Delayed Entry Enlistment Program) shows the applicant was discharged from the DEP on 5 January 2021 and shipped to Basic Combat Training. b. DA Form 3286 (Annex A) shows the applicant enlisted in the RA for a total of 8- years and was assigned to the USAR Control Group (Delayed Entry) in a non-paid status. He volunteered to serve in the RA for 3-years and 24-weeks to begin within 58- days unless he was granted further delay by a proper authority. (1) Paragraph 2, upon enlistment in the RA, he was enlisted under provision of Army Regulation (AR) 601-210 (Regular Army and Reserve Components Enlistment Program) for programs: * 9A (U.S. Army Training Enlistment Program) with request option 07 * 9C (U. S. Army Incentive Enlistment Program (U. S. Army Cash Bonus, 3- year Enlistment)) with request option 173 (U.S. Army Cash Bonus, 3-year Enlistment amount of $8,000.00) (2) Paragraph 2f, he understood the bonus amount was $8,000.00 was authorized by Headquarters, Department of the Army (HQDA) Incentives Message that was effective on the date of his enlistment contract. (3) Paragraph 2h, he acknowledged and understood he would forfeit the bonus if he failed to satisfactorily complete Advanced Individual Training or One Station Unit Training and be awarded the military occupational specialty (MOS) for which he enlisted. He must remain qualified in the incentive MOS for the duration of his initial enlistment unless otherwise directed by HQDA. The applicant signed DA Form 3286 (Annex A) and it was verified on 30 October 2020. c. DA Form 3286 (Annex B) shows the applicant enlisted in the RA in program 9A (U.S. Army Training Enlistment Program with request option 07. Paragraph 5 (Statement and Conditions) apply to all incentive programs listed. He acknowledged and understood he would lose the entitlement to the incentive if he failed to complete training and be awarded the MOS for which he enlisted and must remain qualified in the incentive MOS for the duration of his initial enlistment unless otherwise directed by HQDA. The applicant signed DA Form 3286 (Annex B) and it was verified on 5 January 2021. 3. On 15 April 2022, the U. S. Army Human Resources Command (HRC) provided an advisory opinion regarding the applicant's request for the correction of his service record in order to be paid his $8,000.00 enlistment bonus. The advisory official stated the applicant enlisted in the RA and shipped to BCT for MOS 11X (Infantry Recruit). He successfully completed the required training for the incentive MOS. It was determined DA Form 3286 (Annex A) had incentive 173 (U. S. Army Cash Bonus, 3-year enlistment with the entitlement amount of $8,000.00. It appeared the Guidance Counselor updated the applicant's ship date to 5 January 2021; however, did not update the authorized incentive listed on DA Form 3286 (Annex A) thus made DA Form 3286 (Annex B) silent. The applicant's record was reviewed, and the incentive amount was validated via Keystone, Recruit Quota System (REQUEST), and Department of the Army (DA) message. Therefore, it was determined the applicant is entitled to incentive 173 in the amount of $8,000.00. The advisory official requests Defense Finance and Accounting Service (DFAS) pay the total amount of $8,000.00 for the incentive. 4. On 18 July 2022, the Office of the Deputy Chief of Staff, G1 provided an advisory opinion regarding the applicant's request for the correction of his service record in order to be paid his $8,000.00 enlistment bonus. The advisory official stated the applicant's service record was reviewed, and in conjunction with HRC, Incentives Program Manager Accessions Management Branch, HRC confirmed the applicant is entitled to incentive 173 in the amount of $8,000.00. HRC submitted a memorandum to DFAS requesting a full total payment in the amount of $8,000.00 for the incentive. The advisory official recommended full incentive payment in the amount of $8,000.00. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board determined that relief was warranted. The Board carefully considered applicant's contentions, the military record, and regulatory guidance and agreed that as a result of an administrative error, he was determined to be ineligible for the enlistment bonus. The Board concurred with the G-1 advisory recommending full incentive payment in the requested amount and concurred with the U.S. Human Resources Command determination. Based on the preponderance of the documentation available for review the Board determined the evidence presented sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual be corrected to show he qualified for the enlistment bonus in the amount of $8,000.00 and that he be paid, the exact amount of which to be determined by the Defense Finance and Accounting Services. AR 601-210 (Regular Army and Reserve Components Enlistment Program) prescribes eligibility criteria governing the enlistment of persons, with or without prior service (PS), into the Regular Army (RA), the U.S. Army Reserve (USAR), and the Army National Guard (ARNG). It provides policies and procedures to process applicants for enlistment in the RA Delayed Entry Program (DEP) and on delayed status, and the USAR Delayed Training Program (DTP). a. Paragraph 5-1 (Importance of applicant processing) subparagraph b, persons who prepare, control, and transmit applicant enlistment records and forms will compare similar entries and verify discrepancies with the applicant and establish that entries on the forms are correct before signatures are obtained. b. Paragraph 6-5 (Procedures applicable to RA, USAR, and ARNG), subparagraph k, the guidance counselor will review the enlistment annex which is an important part of the enlistment process to prevent the possibility of an erroneous enlistment, broken enlistment commitments, and misunderstanding on entitlements, assignments, and other matters relating to the enlistment agreement. The counselor ensures that statements for enlistment entered on the enlistment annexes are accurate reflect the enlistment commitment. c. Paragraph 9-9 (Enlistment Program 9C, U. S. Army Incentive Enlistment Program (Enlistment Bonus, Army College Fund, Loan Repayment Program) when authorized by HQDA enlistment incentive message. Incentive will be offered using REQUEST and message. When a member enlisted under the DEP with a concurrent commitment to serve in the Reserve component, the award level of the enlistment incentive is fixed on the date of the enlistment in the DEP, rather than on the date on entry on active duty. 2. Department of Defense Instruction (DoDI) 1304.31 (Enlistment Bonus Program), establishes policy, assigns responsibilities, and prescribes procedures for a bonus payment.
