IN THE CASE OF: BOARD DATE: 8 September 2022 DOCKET NUMBER: AR20220002070 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his foreign service in South Korea. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 256A (Honorable Discharge Certificate) * DA Form 348 (Equipment Operator’s Qualification Record) FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, his time in Korea was omitted from his DD Form 214. He was stationed at Camp Humphreys, Korea in 1968. 3. The applicant enlisted the Regular Army for a period of 3 years on 5 October 1967. He completed his training and was assigned to Company A, 802d Engineer Battalion, Korea. 4. A review of the applicant’s DA Form 20 (Enlisted Qualification Record) shows in item 5 (Oversea Service), he served in Korea from 12 March 1968 to 9 March 1969. He also served in Germany from 29 January 1970 to 25 September 1970. He was transferred to Hawaii for separation processing. 5. The applicant’s DD Form 214 shows he was honorably discharged on 1 October 1970. He was credited with 1 year 7 months 23 days of foreign service with an annotation of Germany. Among his awarded or authorized medals and badges are the National Defense Service Medal and Armed Forces Expeditionary Medal. 6. The applicant provided his honorable discharge certificate showing he was discharged from the Army Reserve on 1 October 1973. He also provided a DA Form 348 showing his was completed equipment qualifications at Camp Humphreys. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Based upon the information reflected in Block 31 of the applicant’s DA Form 20, the information reflected on the applicant’s DD Form 214 was entered in error or warrants correction. The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by correcting Block 22 c (Foreign Service) to read, “2 7 21” 2. Prior to closing the case, the Board did note the administrative note below from the analyst of record and recommended that change also be completed to more accurately reflect the military service of the applicant. ADMINISTRATIVE NOTE(S): The applicant’s record contains sufficient evidence he is entitled to the Korea Defense Service Medal. His DD Form 214 should be amended as follows: Item 24: ADD: Korea Defense Service Medal REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents) in effect at the time, prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service. Section II (Separation Documents) details when and how the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) will be prepared. Section III provides the instructions for the preparation and distribution of the DD Form 214. Paragraph 51.b states for Item 22.c.(Foreign and/or Sea Service) enter total active duty outside continental limits of the United States for the period covered by the DD Form 214 and the last oversea theater in which service was performed, e.g., "Foreign and/ or Sea Service (USAREUR).” 3. AR 600-8-22 (Military Awards) provides, in pertinent part, for the following awards: a. The Korean Service Medal is awarded for qualifying service in the theater of operations between 27 June 1950 and 27 July 1954. b. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The period of eligibility is from 28 July 1954 to a date to be determined by the Secretary of Defense.
