The applicant states: a. She submitted her DA Form 1380 for points-only in September 2021 for duty in July through September. The forms were returned for minor administrative errors on 10 February 2022. However, she was informed about a new requirement, effective 1 January 2022, that required commanders to sign the forms during the same duty month. Since her duty was in September 2021 and the forms were kicked back almost 5 months later, it would be impossible to get a new signature during the same month of duty. b. The points that she earned while conducting duty was approved by her Headquarters and Headquarters Company Commander and should be credited in her military record. 2. The applicant's service record shows: a. On 6 May 2006, the applicant was commissioned as a Reserve Officer with a concurrent call to active duty. b. DD Form 214 (Certificate of Release or Discharge from Active Duty), ending on 20 May 2010, shows the applicant was honorably released from active duty and transferred to the U.S. Army Reserve USAR). She completed 3 years, 11 months, and 21 days of net active service. c. On 8 June 2010, the applicant was commissioned as a Reserve Officer. She remains in the USAR. d. DA Form 5016 (Chronological Statement of Retirement Points) dated 13 February 2023 shows for the retirement year beginning on 6 May 2021 and ending on 5 May 2022 the applicant earned 74 Inactive Duty (I(DT) points, 15 membership points, and 64 active duty points, totaling 153 total points creditable towards retirement. 3. The applicant provides: a. DA Form 1380, dated 10 February 2022, showing the applicant performed points- only duties on the following dates: * 24 July 2021 – 8 hours for N-2 Retirement Points * 25 July 2021 – 8 hours for N-2 Retirement Points * 30 July 2021 – 8 hours for N-2 Retirement Points * 21 August 2021 – 8 hours for N-2 Retirement Points * 22 August 2021 – 8 hours for N-2 Retirement Points * 4 September 2021 – 8 hours for N-2 Retirement Points * 10 September 2021 – 8 hours for N-2 Retirement Points * 11 September 2021 – 8 hours for N-2 Retirement Points The form was endorsed by Captain J- C-, Commanding. b. Email correspondence, Subject: DA Form 1380 (July, August, and September 2021) Return Without Action/Referred to ARBA, dated 10 February 2022, which informed the applicant that her DA Form 1380 were noncompliant with Army Regulation (AR) 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records), Paragraph 3-3 and returned without actions due to errors with Items 1, 3, 7, 9, 9a, 9c, 9d, and 11.She was instructed to forward the forms with additional supporting documentation to the Board for approval. ? BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board agreed it was by no fault of the applicant the forms were kicked back almost 5 months later with a new requirement she had no knowledge of. The Board agreed that there was sufficient documentation to warrant relief in this case by awarding the applicant retirement points for the periods of 24 July 2021, 25 July 2021, 30 July 2021, 21 August 2021, 22 August 2021, 4 September 2021, 10 September 2021, and 11 September 2021, for a total of 16 points. BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by awarding the applicant retirement points for the periods of 24 July 2021, 25 July 2021, 30 July 2021, 21 August 2021, 22 August 2021, 4 September 2021, 10 September 2021, and 11 September 2021, for a total of 16 points. REFERENCES: Army Regulation 140-185 ((Training and Retirement Point Credits and Unit Level Strength Accounting Records) set responsibilities and procedures to establish and maintain retirement records prescribing the types of training and activities for which retirement points are authorized. It discusses the procedures for recording retirement point credits and training. It provides guidance for the use of completing DA Form 1379 (U.S. Army Reserve Components Unit Record of Reserve Training) and DA Form 1380. a. Chapter 2: Paragraph 2-4a states personnel on active duty, Active Duty Training (ADT), Inactive Duty Training (IADT), involuntary ADT, or Annual Training (AT) are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. A maximum of two retirement points may be credited for attendance at unit Battle Assemblies (BA) or IDT in any 1 calendar day. b. Paragraph 3-3 states the purpose of DA Form 1380 is to record IDT by: (1) Troop Program Unit (TPU) Soldiers performing IDT assemblies when pay is authorized, and the Soldier is not present to sign the IDT attendance roster. (2) TPU Soldiers attached to another USAR unit for 89 or fewer days. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3) Non-unit Soldiers under the jurisdiction of HRC who are attached for retirement points-only to USAR TPUs, Army National Guard units, or to another Service or component for training. Only attached Soldiers are authorized to perform Inactive Duty Training with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. (4) Non-unit Soldiers performing other IDT for retirement point credit. c. DA Form 1380 will be prepared for a unit Soldier who performs equivalent training or additional training with their unit subsequent to the scheduled Battle Assembly. TPU units will retain one copy of the DA Form 1380 to post the appropriate entry into Automated Drill Attendance Reporting Software (ADARS) for the month's report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month.
