BOARD DISCUSSION: 1.After reviewing the application, all supporting documents, and the evidence foundwithin the military record, the Board determined that partial relief was warranted.The Board carefully considered applicant’s contentions, the military record, andregulatory guidance. The Board considered the awards and recognitions alreadydenoted on the applicant's DD214. After careful review, in addition to awardsalready denoted, the Board determined the applicant was authorized additionalawards not reflected on his DD214 and that a correction to his record is warranted. 2. This provision of law also allows the ABCMR to excuse an applicant's failure totimely file within the 3-year statute of limitations if the ABCMR determines it would be inthe interest of justice to do so. 2.Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, andadministrative instructions concerning individual and unit military awards. a.Paragraph 1–19 states, only one decoration will be awarded to an individual orunit for the same act, achievement, or period of meritorious service. The award of a decoration in recognition of a single act of heroism or meritorious achievement does not preclude an award for meritorious service at the termination of an assignment. Recommendations for award of a decoration for meritorious service will not refer to acts of heroism or meritorious achievements which have been previously recognized by award of a decoration. Continuation of the same or similar type service already recognized by an award for meritorious service or achievement will not be the basis for a second award. If appropriate, an award may be made to include the extended period of service by superseding the earlier award, or the award previously made may be amended to incorporate the extended period of service. Awards authorities may not recommend a duplicate award for the same act or service from another service component. b.Paragraph 2-16b states, individuals authorized the Afghanistan Campaign Medalmust have served in direct support of Operation Enduring Freedom (OEF). The area of eligibility encompasses all land area of the country of Afghanistan and all air spaces above the land. The Afghanistan Campaign Medal period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. c.Paragraph 2-16c states, Service members qualified for the Global War onTerrorism Expeditionary Medal by reasons of service between 24 October 2001 and 28 February 2005, in an area for which the Afghanistan Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Afghanistan Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. No service member will be entitled to both medals for the same act, achievement or period of service. d.Paragraph 2-17b states, individuals authorized the Afghanistan Campaign Medal(ACM) must have served in direct support of OEF from 11 September 2011 to 31 December 2014, and Operation Freedom’s Sentinel (OFS) from 1 January 2015 to a future date to be determined. The AOE encompasses all land area of the country of Afghanistan and all airspaces above the land. The ACM period of eligibility is on or after 11 September 2001 to a future date to be determined by the SECDEF or the cessation of OFS. e.Paragraph 2-18b states, Individuals authorized the Iraq Campaign Medal (ICM)must have served in direct support of Operation Iraqi Freedom (OIF) or Operation New Dawn (OND). The area of eligibility (AOE) encompasses all land area of the country of Iraq, and the contiguous water area out to 12 nautical miles, and all airspaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The ICM period of eligibility is on or after 19 March 2003 to 31 December 2011, as determined by the SECDEF f.Paragraph 2-20a states, the Global War on Terrorism Expeditionary Medal(GWOTEM) was established by Executive Order 13289, 12 March 2003 to recognize Servicemembers of the Armed Forces of the United States who are deployed abroad for service in the Global War on Terrorism on or after 11 September 2001 to a date to be determined. Specific operations approved for the GWOTEM are provided in paragraphs 2–20d and 2–20f. g.Paragraph 2-21a states, the Global War on Terrorism Service Medal (GWOTSM)was established by EO 13289, 12 March 2003. It is authorized for award to Servicemembers of the Armed Forces of the United States who have participated in or served in support of a Global War on Terrorism operations outside of the designated AOE defined in paragraph 2–21d on or after 11 September 2001 to a future date to be determined. Operations approved for the GWOTSM are provided in paragraph 2–21c. h.Paragraph 2-24 states, the Humanitarian Service Medal (HSM) was establishedby EO 11965, 19 January 1977. It is awarded to Servicemembers of the Armed Forces of the United States who, after 1 April 1975, distinguished themselves by meritorious direct participation in a DOD or DA approved significant military act or operation of a humanitarian nature. i.Paragraph 4-14 states, the Army Reserve Components Achievement Medal(ARCAM) The ARCAM was established by the SECARMY on 3 March 1971 (AGO 1971–30) and amended by AGO 1974–4. It is awarded for exemplary behavior, efficiency, and fidelity while serving as a member of an ARNG unit or USAR TPU or as an IMA. j.Paragraph 4–16a states, the approval authority for award of the ARCAM forARNG Man-Day (M–DAY) units and USAR TPU Soldiers is the Soldier's unit commander. ARCAM approval is announced using an official memorandum. The records custodian will annotate the Soldier’s records and place the memorandum in the Soldier’s AMHRR. k.Paragraph 5-3a states, the Army Reserve Components Overseas TrainingRibbon (ARCOTR) is awarded to member of the Reserve Component of the Army (ARNG and USAR), for successful completion of annual training or ADT for a period not less than 10 consecutive duty days on foreign soil. All ARNG and USAR Soldiers who accompany the RC unit (including unit cells) to which they are assigned or attached as active duty for operational support during overseas training are also eligible for the award. Effective 11 July 1984, all members of the ARNG and USAR are eligible for this award if they were active Reserve status members of the ARNG, USAR (not on active duty in the Regular Army), or AGR Soldiers at the time their unit underwent annual training or ADT on foreign soil. l.Paragraph 6-11a states, service stars are worn on campaign and service medalsto denote participation in a named campaign and on the service ribbons to denote an additional award. 3.Army Regulation 635-5 (Separation Documents) prescribes the separationdocuments that must be prepared for Soldiers on retirement, discharge, release fromactive duty service, or control of the Active Army. Paragraph 2–1 (Preparing the DDForm 214) states, the DD Form 214 is a summary of a Soldier’s most recent period ofcontinuous active duty.
