The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she is requesting the correction because there are a few administrative errors listed on her DD Form 214. The reason for her discharge in listed in box #28 of her DD Form 214 which was as a result of the expiration of her term of service. The other errors that need to be corrected are typos. In fact, the actual address has changed since the DD Form 214 was created. Although the city was misspelled on the document, the city has recently changed to Hollywood. Therefore, the actual address should be listed as . 3. The applicant’s service records are not available for review. An exhaustive search was conducted to locate the service records, but they could not be found. The only documents available were her Enlistment Contract and DD Form 214. These documents are sufficient for the Board to conduct a fair and impartial review of this case. 4. The applicant underwent an enlistment physical on 13 July 1988. Her Report of Medical Examination shows she was born in , and listed her home address as. 5. She enlisted in the U.S. Army Reserve on 13 July 1988. Her DD Form 4 (Enlistment/Reenlistment Document) listed in Item 3 (Home of Record). Her DD Form 1966/1 (Record of Military Processing) listed her * place of birth as * current address as * home of record also as 6. She entered active duty as a member of her Reserve unit on 28 November 1990 and subsequently served in Southwest Asia from 8 January to 9 April 1991. She was honorably released from active duty on 11 May 1991 due to expiration of term of service. By regulation (AR 635-5): * Reserve Component personnel being separated for other than cause will not be assigned RE codes. Enter "NA." * Reserve Component personnel being separated for cause will be assigned in accordance with Table 2-3 of AR 601-210 BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that partial relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board agreed the governing regulation provides that Reserve Component personnel being separated for other than cause will not be assigned RE codes. Enter "NA." As such, her DD Form 214 properly reflects her reentry eligibility code as “NA” due to the applicant serving in the Reserve Component. For that reason, the Board recommended that denying the requested relief was appropriate. However, during deliberation, the Board determined the applicant records is absent awards for her deployment to Southwest Asia for the period of 8 January – 9 April 1991.As such, the Board granted partial relief to properly reflect on her DD Form 214 her deployment. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to more accurately depict the military service of the applicant. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to correction to the applicant’s RE-Code. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers at the time of retirement, discharge, or release from active-duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. The specific instructions for the RE Code: Army Regulation 601-210 (Regular Army and Reserve Components Enlistment Program) determines reentry eligibility and regulates the assignment of the RE code. To deter­ mine the appropriate RE code, review the MPRJ (Military Personnel Records Jacket) refer to table 2-J, SPD/RE CODE CROSS REFERENCE TABLE. More than one RE code may apply but only one code will be assigned in the order of priority shown in the steps on the table. a.
