The applicant states the Army never adjusted his PEBD to reflect his USMCR active drilling dates; those drilling dates correspond to money he was entitled to but never received. This was because the USMCR did not issue him a DD Form 214 but instead only annotated his drilling dates on an annual retirement calculator form. The applicant urges the Board to consider his request in the interests of justice since the error resulted from a series of administrative failures, which were beyond his control. 2. The applicant provides the following documents: a. DD Form 4, showing his 24 April 2013 enlistment into the USMCR for an 8-year term. b. DD Form 214, indicating he entered the USMC's initial entry training, on 13 May 2013. On 19 November 2013 and after the award of military occupational specialty 1391 (Bulk Fuel Specialist), the USMC honorably released the applicant from active duty and returned him to the USMCR; the DD Form 214 shows he completed 6 months and 7 days of net active duty service (i.e. 191 days). c. Three Annual Retirement Credit Records and a Career Retirement Credit Record that reflect the following: (1) The USMCR Annual Retirement Credit Records indicate the applicant's first paid inactive duty for training period occurred on 7 December 2013. Between 7 December 2013 and 5 April 2014, the applicant accrued 22 paid inactive duty for training points. For the next two periods (20140501 to 20150412 and 20150501 to 20160221), the applicant accumulated 52 points and 37 paid inactive duty for training points, respectively. (2) The Career Retirement Credit Record showed that, between 20130424 and 20160414, the applicant accumulated 32 inactive duty points for completed correspondence courses, 45 membership points, 111 paid inactive duty points, and 221 paid active duty points. Total points equaled 409 (i.e. 2 years, 11 months, and 21 days of qualifying service). 3. A review of the applicant's service record reveals the following: a. On 25 April 2016, after having served in the USMCR, the applicant enlisted into the Regular Army for 5 years. Following one-station-unit and airborne training and participating in the Special Operations Preparation Course and Special Forces Assessment and Selection Program, orders assigned the applicant to Eglin Air Force Base (AFB) as a Petroleum Supply Specialist; he arrived at his new unit, on or about 3 May 2017. b. On 3 May 2017, the applicant deployed to Afghanistan; he redeployed to Eglin AFB, on 2 October 2017. c. On or about 8 January 2018, the applicant's career counselor generated a DA Form 1506 (Statement of Service – For Computation of Length of Service for Pay Purposes). (1) The form listed the following service: * Delayed Entry Program, USMCR: 20130424 to 20130512; 19 days * Active Duty, USMC: 20130513 to 20131119; 6 months and 7 days * "USMCR (CP)": 20131120 to 20160424; 2 years, 5 months, and 5 days * Active Duty, U.S. Army: 20160425 to Present (2) The form additionally indicated the applicant's BASD (Basic Active Service Date) was 20151018, and his PEBD was 20130513. d. On 24 April 2021, the Army honorably discharged the applicant based on reaching his expiration term of service; his DD Form 214 shows he completed 5 years of net active duty service, with 6 months and 7 days of prior active service and 1 year, 11 months, and 17 days of prior inactive service. 4. Army Regulation (AR) 637-1 (Army Compensation and Entitlements Policy), currently in effect, is the governing regulation for the DA Form 1506. Chapter 2 (Creditable Service) provides guidance on determine what service is deemed creditable and not creditable. a. Paragraph 2-2 (Establishing Creditable Service). All Soldiers on active duty for more than 179 days or who have reentered active duty after a break in service must have a DA Form 1506 completed by their unit active duty career counselor. b. Paragraph 2-3 (Service that is Creditable). For most Soldiers who enter and serve on active duty without a break in service, the PEBD and BASD is the date the Soldier enters service. However, there are statutory periods of service in certain components that a Service may not use when computing creditable service dates. Creditable service period include Regular service in the Army, Air Force, Navy, Coast Guard and Marine Corps. Additionally, service in the Army, Naval, Marine Corps, Air Force, and Coast Guard Reserve is creditable. c. Paragraph 2-4 (Service Not Creditable). Do not use any service that is not listed as creditable service to compute a PEBD or BASD. For enlistments entered into on or after 29 November 1989, any period of inactive service as a Reserve Component enlisted Soldier and under a delayed entry program is not considered creditable unless the Soldier participates in active duty for training prior to beginning his/her initial period of active duty for training. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The governing regulation provides that any period of inactive service as a Reserve Component enlisted Soldier and under a delayed entry program is not considered creditable and further states do not use any service that is not listed as creditable service to compute a PEBD or BASD. The Board determined there was insufficient evidence of an error or injustice to warrant relief in this case. ?
