Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20180006156, dated 7 August 2018. 2. The applicant states he wants to have his BSM added to his DD Form 214. 3. The applicant provides the following documents: a. A photograph of a person in a military uniform in what appears to be a Soldier receiving an award. b. BSM Certificate, dated 15 May 1991, which lists his name for exceptional meritorious achievement in support of actions against a hostile force in the Persian Gulf from 17 January 1991 through 2 March 1991, while assigned to XVIII Airborne Corps Artillery Corps, Saudi Arabia. c. Newspaper article, dated 4 April 1993, which reflects a picture of the applicant and states that he was the youngest recipient of a BSM in the 3rd Battalion, 27th Field Artillery, 82nd Airborne Division, during Operation Desert Storm. 4. A review of the applicant’s service record shows the following documentation: a. On 23 March 1989, he enlisted in the Regular Army. b. His DA Form 2-1 (Personnel Qualification Record) shows in: * Item 5 (Oversea Service) – Saudi Arabia 28 August 1990 thru 27 March 1991 * Item 9 (Awards, Decorations and Campaigns): does not reflect the BSM * Item 27 (Remarks) – duty in imminent danger pay area Southwest Asia 28 August 1990 – 27 March 1991 * Item 35 (Record of Assignments) – he was assigned to Headquarters and Headquarters Company, 3rd Battalion, 27th Field Artillery, Fort Bragg, NC from 22 November 1989 to 21 March 1992 5. His DD Form 214 shows he was honorably released from active duty on 22 March 1992. He completed 3 years of net active service with 7 months of foreign service. It further shows in: a. Item 8a (Last Duty Assignment and Major Command) – Headquarters and Headquarters Battery, 3rd Battalion, 27th Field Artillery Regiment. b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): does not reflect the award of the BSM. c. Item 18 (Remarks) – service in Southwest Asia from 28 August 1990 to 27 March 1991. 6. The applicant’s record does not contain any permanent orders authorizing him the award of the BSM. 7. Prior ABCMR Docket Number AR20180006156, dated 7 August 2018, reflects the Board denied his request for a BSM. The Board reasoned that there were no orders in his service record, which awarded him the BSM. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was not warranted. The Board carefully considered the applicant's request, the former service members record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on public law, policy and regulation. The governing regulation provides that as with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. Upon review of the applicants petition and available military records, the Board concluded there was insufficient evidence in the service record nor did the applicant provide orders to warrant award of the BSM. The Board agreed that reversal on the previous decision is not warranted. Therefore, the Board denied relief. Army Regulation 600-8-22 (Military Awards) states, the BSM is awarded in time of war for heroism and for meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy, or while engaged in military operations involving conflict with an opposing armed force in which the United States is not a belligerent party. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214.
