The applicant did not file within the three-year period provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his MOS is not correct. He provides the following information and timelines in conjunction with his MOS: a. He was assigned to Fort Lee, VA in 1969 and was awarded MOS 57F2O (Memorial Activities Specialist). b. He was assigned to Vietnam from 1970 - 1971 and served in MOS 57F2O and MOS 11B2O (Infantryman), c. He reenlisted in Fort Bragg, NC in 1971. d. In 1972, he was stationed at Headquarters and Headquarters Company, 3rd Advanced Individual Training (AIT) Brigade and assigned to a Rifle Squad Tactics (RST) Range in MOS 11B as an RST instructor. e. In 1973, he was assigned to Fort Riley KS in the Air Evacuation Section, Registrar Division as the Air Evacuation Noncommissioned Officer (NCO) and was awarded his flight wings. 3. The applicant’s service records are not available for review. The only documents available were the documents provided by the applicant. These documents are sufficient for the Board to conduct a fair and impartial review of this case. 4. The applicant enlisted in the Regular Army on 13 July 1971, after having prior enlisted service. He served in Vietnam from 27 March 1970 until 3 March 1971. 5. The applicant provided: a. S.O. Number 277, issued by Headquarters, United States Army Training Center, Fort Jackson, SC, on 22 November 1969, shows he was to be reassigned to attend Memorial Activities Specialist course for 8 weeks. The order shows his MOS as 57F2O. b. Letter of Commendation, dated 29 August 1970, commending him on his performance of duty during the period 14 July 1970 through 24 August 1970. c. S.O. Number 41, issued by Headquarters, 23d Infantry Division, on 10 February 1971, lists his MOS as 57F2O and shows he was being reassigned. d. S.O. Number 108, issued by Headquarters, 12th Support Brigade, Fort Bragg NC on 6 May 1971, lists his as 57F2O and shows he was authorized separate rations. e. S.O. Number 51, issued by Headquarters, United States Army Training Center Infantry, Fort Jackson, SC, on 8 March 1972, lists his MOS as 57F2O and shows he was to be reassigned. f. A memorandum, Subject: Recommendation for Flying Status, dated 11 July 1972, wherein it states he occupied a position of Evacuation Clerk in the Air Evacuation Section, Registrar Division and recommended for flying status because it was necessary in the discharge of his primary duties. This memorandum lists his MOS as 71G2O (Medical Records Specialist). g. S.O. Number 3, issued by Headquarters Medical Activity Department, on 4 January 1973 contains the following MOS actions, effective 3 January 1973: * Awarded - * Secondary MOS(SMOS) 71G2O * Alternate MOS (AMOS) 71B2O (Clerk Typist) * Withdrew - SMOS 71B2O 6. His record does not contain, nor did he provide official orders awarding or listing his MOS as 11B. 7. He was honorably released from active duty on 10 January 1975. His DD Form 214 shows: * Item 16a (Primary Specialty Number and Title): 71G2O Medical Records Specialist 86 4 May 1973 * Item 17a (Secondary Specialty Number and Title): 71B3O Clerk Typist 3 January 1973 BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined partial relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Based upon the available documentation including orders showing the applicant was trained and awarded MOS 57F on 22 Nov 69 and awarded 71G on 4 Jan 73, the Board concluded those two MOS should be reflected on the applicant’s DD Form 214. The Board, however, found no orders showing he was training and awarded for the 11B MOS. Therefore, the Board recommended denying that portion of the relief requested. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by adding to block 16a “57F20, 22 NOV 69, Memorial Activities Spec” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to any other relief not reflected above. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents) states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Item 16a (Primary specialty number and title). Enter the MOS code, title, and date of award. Also, for enlisted personnel enter PMOS evaluation score and date of score. b. Item 17a (Secondary specialty number and title). Enter the MOS code, title, and date of award.
