APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders RY-251-0195, 8 September 2015 with Two Amendments * Orders RY-222-2530, 10 August 2017 * NATO Travel Orders, 10 August 2017 * Orders RY-224-0163, 12 August 2017 FACTS: 1. The applicant states he is missing his deployments on his DD Form 214 (Certificate of Release or Discharge from Active Duty). The corrections are required for his burn pit application. 2. The applicant provides the above listed documents to be referenced in the service record. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 4 November 2013. b. His Enlisted Record Brief shows he deployed to Kuwait from 20 October 2015 through 21 June 2016 (8 months). c. Orders RY-251-0195, dated 4 September 2015, deployed the applicant in support of Operation Enduring Freedom (Spartan Shield) for a period not to exceed 365 days and a report date on or about 22 October 2015. d. Two amendments were published for Orders RY-251-0195: * Orders RY-251-0195 (A1) – amended the location from United Arab Emirates to Camp Buerhing, Kuwait * Orders RY-251-0195 (A2) – amended the proceed date from 22 October 2015 to 20 October 2015 e. A DA Form 638 (Recommendation for Award) shows the applicant received an Army Achievement Medal for his deployment to Kuwait with a period of award from 18 October 2015 through 5 July 2016. f. Orders RY-222-2530, dated 10 August 2017, deployed the applicant in support of Atlantic Resolve – European Reassurance for a period not to exceed 270 days and a report date on or about 15 September 2017. g. A NATO Travel Order, signed 10 August 2017, shows the applicant’s date of departure was 15 September 2017 with an expected date of return on 11 June 2018. h. Orders RY-224-0163, dated 12 August 2017, awarded the applicant assignment incentive pay effective 15 September 2017 with an expected termination date of 11 June 2018. i. Orders RY-222-2530 (A1), dated 10 September 2017, amended the accounting code in Orders RY-222-2530. j. A DA Form 199 (Formal Physical Evaluation Board (PEB) Proceedings) shows on 6 May 2021 a formal PEB convened and found the applicant physically unfit. The PEB recommended a combined rating of 50% and that the applicant’s disposition be permanent disability retirement. His unfitting conditions were listed as hemangioma of intracranial structures and localization-related (focal, partial) symptomatic epilepsy and epileptic syndromes with simple partial seizures not intractable without status epilepticus (VASRD Codes 8020-8912) and lumbosacral strain (VASRD Code 5237). k. Orders 175-0520, dated 24 June 2021, released the applicant from assignment and duty because of physical disability incurred while entitled to basic pay under conditions that permitted his retirement for permanent physical disability with a 50% disability rating effective 6 October 2021. l. He was honorably retired from active duty on 6 October 2021. His DD Form 214 shows he completed 7 years, 11 months, and 3 days of active service. It also shows: * Block 12f (Foreign Service) – 00 08 02 (Years, Months, Days) * Block 18 (Remarks) – No comments included regarding a deployment 4. A review of the applicant’s service record confirms administrative entries were omitted from his DD Form 214. Foreign service supported by documentation in the service record will be added to his DD Form 214 as an administrative correction and will not be considered by the Board. The Board will consider his request for additional deployment credit for his support of Operational Atlantic Resolve on 15 September 2017. 5. On 7 September 2022, a member of the Defense Finance and Accounting Services (DFAS) staff provided email verification to confirm the applicant served in Poland in a non-imminent danger pay status from 7 September 2017 to 18 December 2017 (3 months and 2 days). 6. By regulation, (AR 635-8) the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. Item 12f (Foreign Service), states enter the total amount of service performed outside the continental United States (OCONUS) during the period covered in block 12c. In addition, list periods of deployed service in block 18. b. Item 18 (Remarks), for active duty Soldiers deployed with their unit during their continuous period of active service, enter "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. Evidence of record shows he served in Poland; however, the deployment period is not shown on his DD Form 214. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to depict the military service of the applicant more accurately. ADMINISTRATIVE NOTE(S): A review of the applicant’s service records shows foreign service was omitted from his DD Form 214 for the service period ending 6 October 2021.
