Heis requesting point correction to have enough good years to reenlist in the U.S. Army Reserve in order to retire with 20 years of service. b.He has an additional 10 days of performed duty with the Syracuse RecruitingBattalion in July 2017 and September 2017 that would give him 20 Inactive Duty (IDT) points. He also has an additional 13 days performed duty with the Syracuse Recruiting Battalion in March 2019 and September 2019 that would give him 26 IDT points. c.He was an Individual Mobilization Augmentee Soldier during this time andassigned to the Defense Information School (DINFOS). The original DA Forms 1380 were submitted to DINFOS, but never turned into HRC. He had the DA Forms 1380 resigned after the errors were corrected. He mailed the corrected DA Forms 1380, DD Form 149, and a Memorandum of Justification of Lateness on 3 December 2021 and the forms were signed on 9 December 2021. He has since realized that he submitted the 2014 version of the DD Form 149, so he resubmitted the updated version. 2.The applicant's service record shows: a.On 27 September 1991, the applicant enlisted in the U.S. Army Reserve (USAR). b.DD Form 214 (Certificate of Release or Discharge from Active Duty), ending on17 February 1997, shows the applicant was honorably released from active duty. (1)Block 12a (Date Entered Active Duty This Period) – 15 June 1996. (2)Block 12c (Net Active Service This Period) – 0 years, 8 months, and 3 days. (3)Block 12d (Total Prior Active Service) – 0 years, 2 months, and 7 days. (4)Block 12e (Total Prior Inactive Service) – 4 years, 6 months, and 11 days. The documentation was signed and submitted upon completion of each tour of duty in the prescribed time. He is unsure what happened to the documents once mailed; however, he is aware that the applicant had issues receiving confirmations and requests for corrections once he was reassigned from his original assignment with the Pacific Command. He had several conversations with IMA support and HRC and was assured the documents would be processed. c.HRC letter, dated 3 January 2022, in response to the office of Senator C___S___, acknowledged receipt of the applicant's case. The office was to instruct the applicant to submit a signed request for a new update along with supporting documentation to HRC. In addition, the applicant's request was forwarded to the Army Board for Correction of Military Records (ABCMR) for correction action. d.DA Form 5016, dated 7 July 2022, showing the applicant's retirement points forthe period covering 27 September 1991 to 24 March 2020: •381 Inactive Duty Points •787 Active Duty Points •15 Qualifying Retirement Years •1630 Total Points Creditable (1)Retirement year beginning on 27 September 2016 and ending on 26 September 2017 shows 16 IDT points, 15 membership points, 13 active duty points, totaling 44 total points creditable. (3)Retirement year beginning on 27 September 2018 and ending on 26 September 2019 shows 6 IDT points, 15 membership points, 11 active duty points, totaling 32 total points creditable. BOARD DISCUSSION: 1.The applicant's request for a personal appearance was carefully considered. In thiscase, the evidence of record was sufficient to render a fair and equitable decision. As aresult, a personal appearance before the Board is not necessary to serve the interest ofequity and justice in this case. 2.After reviewing the application, all supporting documents, and the evidence foundwithin the military record, the Board determined that relief warranted. The Boardcarefully considered applicant's contentions, the military record, and regulatoryguidance. The Board reviewed the provided Human Resource Commandmemorandum in reference to the applicant’s request and concurred with thedetermination. Based on the preponderance of evidence available for review, the Boarddetermined the evidence presented sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he submitted properly constituted DA Forms 1380 for the periods of rescheduled training performed, in a timely manner, to the appropriate HRC office for service credit consideration. REFERENCES: 1.Army Regulation (AR) 15-185 (ABCMR)prescribes the policies and procedures forcorrection of military records by the Secretary of the Army, acting through the ABCMR.The ABCMR may, in its discretion, hold a hearing or request additional evidence oropinions. Additionally, it states in paragraph 2-11 that applicants do not have a right to ahearing before the ABCMR. The Director or the ABCMR may grant a formal hearingwhenever justice requires. 2.AR 140-185 (Training and Retirement Point Credits and Unit Level StrengthAccounting Records) sets responsibilities and procedures to establish and maintainretirement records prescribing the types of training and activities for which retirementpoints are authorized. It discusses the procedures for recording retirement point creditsand training. It provides guidance for the use of completing DA Form 1380.Paragraph 3-3 states: a.The purpose of this form is to record Inactive Duty Training by: (1)Troop Program Unit Soldiers performing Inactive Duty Training assemblieswhen pay is authorized, and the Soldier is not present to sign the Inactive Duty Training attendance roster. (2)Troop Program Unit Soldiers attached to another USAR unit for 89 or fewerdays. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3)Non-unit Soldiers under the jurisdiction of HRC who are attached forretirement points-only to USAR Troop Program Units, Army National Guard units, or to another Service or component for training. Only attached Soldiers are authorized to perform Inactive Duty Training with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. (4)Non-unit Soldiers performing other inactive duty training for retirement pointcredit. b.DA Form 1380 will be prepared for a unit Soldier who performs equivalenttraining or additional training with their unit subsequent to the scheduled Battle Assembly. Troop Program Unit units will retain one copy of the DA Form 1380 to post the appropriate entry into Automated Drill Attendance Reporting Software (ADARS) for the month's report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month. DA Form 1380 will be scanned into the Soldier's iPERMS by the unit of assignment. c.Chapter 2: Paragraph 2-4a states personnel on active duty, Active Duty Training(ADT), Inactive Duty Training (IADT), involuntary ADT, or Annual Training (AT) are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status.
