The applicant states in pertinent part that he retired from active duty on 31 January 2016. After retiring, he decided to reside temporarily in and annually requested an extension of his HHG shipping entitlements through the Fort Riley, KS Installation Transportation Office. However, with the uncertainty of the COVID-19 pandemic and travel restrictions, particularly those for travelers entering the, there are increased concerns related to health risks and disruptions occurring while relocating to his Home of Selection (HOS) in the. He has two children enrolled in school. His son is in the 3rd grade and they would like for him to continue his education in that school until he completes the 5th grade. His daughter is currently working towards completing her associate degree at in Fort Riley, KS and would like to continue being educated at that college until her degree is awarded. 2. A review of the applicant's available service records reflects the following: a. On 9 January 1990, the applicant enlisted in the Regular Army. His home of record at the time of his enlistment was in the Philippines. b. On 30 March 2015, Headquarters, 1st Infantry Division and Fort Riley issued Orders Number 089-0030 reassigning the applicant pending separation. He was advised that he was authorized up to 1 year to ship household goods to his HOS. c. On 31 January 2016, the applicant was released from active duty for retirement. His last duty assignment was at Fort Riley, KS. 3. The applicant provides the following a: a. Memorandum – Subject: Request First Time HHG Shipment Entitlement Extension dated 6 December 2016, reflective of a 1-year extension approval of the applicant's HHG shipping entitlement with an expiration date of 30 January 2018. He was further advised that he may be entitled to a total of 5 additional extensions in accordance with his retirement orders not to exceed a total of 6-years. b. Memorandum – Subject: Request Second Time HHG Shipment Entitlement Extension dated 29 November 2017, reflective of a 1-year extension approval of the applicant's HHG shipping entitlement with an expiration date of 15 January 2019. He was again advised that he may be entitled to a total of 5 additional extensions in accordance with his retirement orders not to exceed a total of 6-years. c. Memorandum – Subject: Request Third Time HHG Shipment Entitlement Extension dated 8 November 2018, reflective of a 1-year extension approval of the applicant's HHG shipping entitlement with an expiration date of 30 January 2020. He was again advised that he may be entitled to a total of 5 additional extensions in accordance with his retirement orders not to exceed a total of 6-years. d. Memorandum – Subject: Fourth Request for Extension on Time Limitation for Travel and HHG Shipment Entitlement dated 8 January 2020, reflective of the applicant being authorized a 1-year extension of his HHG shipping entitlements with an expiration date of 31 January 2021. e. Memorandum – Subject: Fifth and Final Request for Extension on Time Limitation for Travel and HHG Shipment Entitlement dated 23 December 2020, reflective of the applicant being authorized a 1-year extension of his HHG shipping entitlements with an expiration date of 31 January 2022. f. Self-authored letter dated 27 September 2021, reflective of the applicant's justification for a 6th extension of his HHG shipping entitlement. The information contained within his statement is previously addressed in his opening statement to this Board. 4. On 27 May 2022, the Office of the Deputy Chief of Staff, G-4, Chief, Transportation Policy Division, provided an advisory opinion citing that the applicant's entitlement to Travel and Transportation to HOS with extensions expired on 31 January 2022 in accordance with the Joint Travel Regulation (JTR). An examination of this request indicates a need for a total of eight extensions to meet his dependents current education requirements. The G-4 office lacks the JTR authority to approve a sixth or subsequent extension of an expired travel and transportation authorization. 5. On 31 May 2022, the applicant was provided with a copy of the advisory opinion and afforded 15 days to provide comments. As of 7 September 2022, the applicant had not responded. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant's contentions, the military record, an advisory opinion, and regulatory guidance were carefully considered. Based upon a preponderance of the evidence, the Board determined the applicant’s transportation authorization has reached the limit for extensions, and there is no error or injustice in this case. REFERENCES: JTR section 052013 C1 (HHG Transportation in Connection with Retirement) states a Service member is authorized HHG transportation from the last permanent duty station to the Service Member's Home of Selection (HOS). Extensions may be granted through the Secretarial process for an unexpected event beyond the Service member's control that occurs and that prevents him or her from moving to the HOS within the specified time limit. A Service member must request all extensions in writing using the Secretarial process.
