The applicant states, in effect: a. Retirement points were not being applied for his retirement. He submitted a request for correction on multiple occasions to HRC with supporting documents. A reply was received from HRC for corrections recommending the matter be referred to the Army Board of Correction for Military Records (ABCMR) as it had passed the submission window and thus had to be submitted to the ABCMR. b. Unit administrative personnel failed to properly submit his DA Forms 1380 to HRC to have the retirement points applied. 2. The applicant's service records contain the following documents for the Board's consideration: a. DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States), which shows the applicant enlisted in the US Army Reserve (USAR) on 19 December 1997 for a period of 8 years. b. DD Form 4 which shows the applicant reenlisted in the USAR on 15 March 2006 for a period of 6 years. c. DA Form 5016 (Retirement Accounting Statement), which shows from for the retirement year beginning on 19 December 2019 and ending on 18 December 2020, he received 2 Inactive Duty (IDT) points, 15 membership points, 29 Active Duty Points, totaling 46 total points creditable. d. The applicant's service record is void of DA Forms 1380 showing he performed IDT. 3. The applicant provides the following documents for the Board's consideration: a. Seven IDT attendance rosters, which show: * 4 February 2020, he was marked as N for 6 through 9 February 2020 * 6 March 2020, he was marked as N for 7 through 8 March 2020 * 27 April 2020, he was marked as N for 24 through 26 April 2020 * 17 May 2020, he was marked as N for 16 through 17 May 2020 * 22 June 2020, he was marked as N for 20 through 21 June 2020 * 23 October 2020, he was marked as N for 24 through 25 October 2020 * 5 November 2020, he was marked as N for 7 through 8 November 2020 b. Seven DA Forms 1380 dated 27 February 2021, which show he performed duty on: * 6 through 9 February 2020, 8 hours per day – Battle Assemblies (BA), Operations Noncommissioned Officer (NCO) duties, totaling 8 points * 7 through 8 March 2020, 8 hours per day - BA, Operations NCO duties, totaling 4 points * 24 through 26 April 2020, 8 hours per day - BA, Operations NCO duties, totaling 6 points * 16 through 17 May 2020, 8 hours per day - BA, Operations NCO duties, totaling 4 points * 20 through 21 June 2020, 8 hours per day - BA, Operations NCO duties, totaling 4 points * 24 through 25 October 2020, 8 hours per day - BA, Operations NCO duties, totaling 4 points * 7 through 8 November 2020, 8 hours per day - BA, Operations NCO duties, totaling 4 points c. An email from HRC, dated 9 July 2021, which states the submitted DA Forms 1380 were returned without action due to the date prepared block was blank, incorrect, not legible, or late. Date entered must be on or after the last duty date performed but not later than the end of the duty month. Per Army Regulation (AR) 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records) DA Forms 1380 should be forwarded to HRC for award of retirement points no later than the end of each duty month. DA Forms not in compliance with the regulation should be sent to the ABCMR with any additional supporting document to justify the circumstances. d. An email from the applicant's Army Reservice Administrator, dated 9 January 2022 to HRC, which states she had sent the DA Forms 1380 back on 13 May 2021 and additionally throughout the rest of 2021 and had not heard back. The applicant was trying to retire and needed his points updated. HRC replied to the email on 10 January 2022 referring the unit administrator to the email from HRC, dated 9 July 2021. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is warranted. 2. The Board found that, had the seven DA Forms 1380 dated 27 February 2021 been submitted in a timely manner, the applicant would have been credited with the retirement points he earned. The Board determined it would be appropriate to correct the record by crediting him with the retirement points documented on the forms. BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected to show DA Forms 1380 for duty performed on the following dates were submitted in a timely manner and by updating his record to add the retirement points earned for those periods of service. * 6 through 9 February 2020 * 7 through 8 March 2020 * 24 through 26 April 2020 * 16 through 17 May 2020 * 20 through 21 June 2020 * 24 through 25 October 2020 * 7 through 8 November 2020 I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCE: AR 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records) sets responsibilities and procedures to establish and maintain retirement records prescribing the types of training and activities for which retirement points are authorized. It discusses the procedures for recording retirement point credits and training. It provides guidance for the use of completing DA Form 1380. Paragraph 3-3 states: a. The purpose of this form is to record IDT by: (1) Troop Program Unit Soldiers performing Inactive Duty Training assemblies when pay is authorized, and the Soldier is not present to sign the Inactive Duty Training attendance roster. (2) Troop Program Unit Soldiers attached to another USAR unit for 89 or fewer days. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3) Non-unit Soldiers under the jurisdiction of HRC who are attached for retirement points-only to USAR Troop Program Units, Army National Guard units, or to another Service or component for training. Only attached Soldiers are authorized to perform Inactive Duty Training with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. (4) Non-unit Soldiers performing other inactive duty training for retirement point credit. b. DA Form 1380 will be prepared for a unit Soldier who performs equivalent training or additional training with their unit subsequent to the scheduled BA. Troop Program Unit units will retain one copy of the DA Form 1380 to post the appropriate entry into Automated Drill Attendance Reporting Software (ADARS) for the month's report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month. DA Form 1380 will be scanned into the Soldier's iPERMS by the unit of assignment. c. Chapter 2: Paragraph 2-4a states personnel on active duty, Active Duty Training (ADT), Inactive Duty Training (IADT), involuntary ADT, or Annual Training (AT) are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. A maximum of two retirement points may be credited for attendance at unit BA or IDT in any 1 calendar day. d.
