APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DA Form 1380, 31 January 2021 * U.S. Army Human Resources Command (HRC), Fort Knox, KY Memorandum – Subject: DA Form 1380 Returned without Action, 2 March 2022 FACTS: 1. The applicant states: a. The unit commander was not available to sign the DA Form 1380 during the duty month due to his unavailability related to his civilian job. HRC returned the DA Form 1380 after it was submitted due to multiple errors on the DA Form 1380 that have now been corrected. He was instructed to submit this form for correction to the Army Review Boards Agency. b. The duty was performed, and the DA Form 1380 was submitted to his chain of command for signature. It was not signed in a timely manner before the end of the duty month due to the unit commander being in the Reserve as a Troop Program Unit (TPU) status Soldier and was not available to sign. 2. A review of the applicant's official military records show the following: a. Having had prior enlisted service in the U.S. Navy, the applicant enlisted or entered the U.S. Army Reserve (USAR) on 24 January 1998. b. On 23 June 2022, Headquarters, 63rd Readiness Division (USAR), Mountain View, CA, issued Orders 22-174-00002 assigning the applicant to the Retired Reserve, HRC, Fort Knox, KY, effective 21 September 2022. He completed 20 or more years of qualifying service for Retired Pay at age 60. c. The applicant's record contains a DA Form 5016 (Chronological Statement of Retirement Points) that shows during the anniversary year of 21 October 2020 to 20 October 2021, he earned 91 Inactive Duty (IDT) points, 15 membership points, 19 active duty points, 1 qualifying year for retirement, and 125 total points creditable. 3. The applicant provides: a. DA Form 1380 dated 31 January 2021 showing on 2, 4, 8, 12, 13, 16, 20, 26, and 30 January 2021 for 4 hours each day (N1, Non-Paid), he performed medical readiness noncommissioned officer duties, totaling: 9 points. b. Memorandum, Subject: DA Form 1380 Returned without Action dated 2 March 2022, returning his DA Form 1380 without action for a missing anniversary year, nature of duties, DA Form 1380 not forwarded to HRC before the end of the duty month. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The governing regulation states that the DA Forms 1380 should be forwarded to HRC for award of retirement points no later than the end of each duty month. Therefore, a digital signature date that exceeds the end of the duty month will not be in compliance with the governing regulation. The evidence of record shows the applicant submitted an incomplete and/or improperly constituted DA Form 1380. The Board recommends the applicant submits an accurate, properly completed form, timely, and appropriately authenticated by the appropriate official, if she desires reconsideration of her case. ? In pertinent part, individual retirement points are approved for: * conducting or reviewing medical examinations, and related medical duties * attachment to appropriate Reserve Component TPUs * participation in approved training projects or using administrative skills in support of TPU and USAR activities * attendance at Army service or Army area school training * enrollment in appropriate extension courses * attendance at authorized conventions, professional conferences, or appropriate trade association meetings related to the individual's mobilization specialty 2.
