The applicant states that DA Forms 1380, dated 21 April 2021 and 3 May 2021, were not processed. The duty was performed, but he did not receive retirement point credit. 2. The applicant's service record shows: a. On 3 June 2008, having had prior enlisted service in the U.S. Marine Corps, the applicant enlisted in the U.S. Army Reserve (USAR). b. On 18 July 2008, the applicant reenlisted in the USAR for 6 years. On 18 February 2016, he reenlisted in the USAR indefinitely. c. DA Forms 1380, dated 8 September 2019 and 5 October 2019, shows the applicant completed rescheduled training on the following dates: * 7 September 2019 for 8 hours for P2 Retirement Points * 8 September 2019 for 8 hours for P2 Retirement Points * 3 October 2019 for 8 hours for P2 Retirement Points d. DA Form 1380, dated 13 August 2021, shows the applicant performed points- only training on 12 August 2021 for 4 hours for N1 Retirement Points. e. U.S. Army Human Resources Command (HRC) Memorandum, Subject: Notification of Eligibility for Retired Pay for Non-Regular Service (20-Year Letter), dated 11 July 2022, shows the applicant completed the required years of qualifying Reserve service and would be eligible for retired pay upon application at age 60. f. DA Form 5016 (Chronological Statement of Retirement Points), dated 22 December 2022, shows for the retirement year beginning on 28 October 2020 and ending on 27 October 2021, the applicant earned 34 Inactive Duty (IDT) points, 15 membership points, and 4 active duty points, totaling 53 points creditable. g. DA Form 199 (Informal Physical Evaluation Board (PEB) Proceedings) dated 25 January 2023, found the applicant physically unfit and recommended permanent disability retirement at 80 percent. h. Orders Number D-033-12 issued by Headquarters, U.S. Army Physical Disability Agency, dated 2 February 2023, released the applicant due to a physical disability, effective 3 April 2023 and placed him on the retired list, effective 4 April 2023. 3. The applicant provides Army Reserve Careers Group Memorandum, Subject: Late Submission of DA Forms 1380 for Points, dated 21 January 2022, in which the applicant's intermediate commander resubmitted the following DA Forms 1380 to HRC after a records review and the completion of administrative corrections. The commander acknowledged that the forms were not processed within the required 30 days and requested that the applicant's records reflect the missing retirement points. * DA Form 1380 for 11 April 2021; 8 hours; 2 points * DA Form 1380 for 1 May 2021 and 2 May 2021, 8 hours each day, 4 points * DA Form 1380 for 14 July 2021 and 15 July 2021 (not submitted as part of this application) * DA Form 1380 for 12 August 2021 (not submitted as part of this application) 4. In the processing of this case, an advisory opinion was obtained from the U.S. Army Reserve Command, Retirement Services Office on 20 January 2023. The advisory official recommended approval of the applicant's request. It states in pertinent part that the applicant is eligible to transfer retirement points for 11 April 2021, 1 May 2021, and 2 May 2021. DA Form 5016 (Retirement Accounting Statement) should be updated to reflect the correction. 5. The advisory opinion was provided to the applicant to afford him the opportunity to respond to its content. He did not respond. ? BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered applicant’s contentions, military record and regulatory guidance. The Board noted that the U.S. Army Reserve Command, Retirement Services Office provided an advisory opinion which recommended approval. The Board concurred with the opinion. Based on the preponderance of evidence available for review, the Board determined the evidence presented sufficient to warrant a recommendation for relief. REFERENCE: Army Regulation 140-185 (Army Reserve - Training and Retirement Point Credits and Unit Level Strength Accounting Records) sets responsibilities and procedures to establish and maintain retirement records prescribing the types of training and activities for which retirement points are authorized. It discusses the procedures for recording retirement point credits and training. It provides guidance for the use of completing DA Form 1380. a. It discusses the procedures for recording retirement point credits and training. Retirement points are awarded for membership, active duty for training, active duty, mobilization, training, and other situations. b. Retirement points may be earned by USAR Soldiers for active duty or duty in an active status for active duty for training, initial active duty for training, involuntary active duty for training, annual training, inactive duty training, membership points, and for other activities specified in this regulation. The types of inactive duty training are: * Regularly scheduled unit training assembly include battle assemblies formally known as unit training assemblies * Rescheduled training * Make-up assemblies for missed battle assemblies due to annual training * Equivalent training in lieu of scheduled battle assemblies or rescheduled training * Additional training assemblies * Two-hour funeral honor inactive duty training * Training of individual Soldiers in non-pay status c. Chapter 2: Paragraph 2-4a states personnel on active duty, Active Duty Training, Inactive Duty Training, involuntary Active Duty Training, or Annual Training are awarded one point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. A maximum of two retirement points may be credited for attendance at unit Battle Assemblies or Inactive Duty Training in any 1 calendar day. d. Paragraph 3-3 states the purpose of DA Form 1380 is to record Inactive Duty Training by: (1) TPU Soldiers performing Inactive Duty Training assemblies when pay is authorized, and the Soldier is not present to sign the Inactive Duty Training attendance roster. (2) TPU Soldiers attached to another USAR unit for 89 or fewer days. In such cases the unit of attachment will prepare DA Form 1380 and forward to unit of assignment for recording attendance. (3) Non-unit Soldiers under the jurisdiction of HRC who are attached for retirement points-only to USAR TPUs, Army National Guard units, or to another Service or component for training. Only attached Soldiers are authorized to perform Inactive Duty Training with the exception of one annual physical health assessment each for medical and dental readiness when authorized by the command prior to the event. (4) Non-unit Soldiers performing other Inactive Duty Training for retirement point credit. e. DA Form 1380 will be prepared for a unit Soldier who performs equivalent training or additional training with their unit subsequent to the scheduled Battle Assembly. TPU units will retain one copy of the DA Form 1380 to post the appropriate entry into Automated Drill Attendance Reporting Software (ADARS) for the month's report and then place in the appropriate Army records information management system file. Nonpaid DA Forms 1380 will not be entered into ADARS and will be forwarded to HRC for award of retirement points no later than the end of each duty month.
