The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant, in effect, he wants to add the awards/certificates he has attached, to his DD Form 214. 3. Review of the applicant’s service records shows: a. He enlisted in the Regular Army on 7 January 1992, and he held military occupational specialty 92G (Cook). He also completed the Basic Airborne Course. He reenlisted on 7 January 1992. b. He was assigned mostly to the 19th Replacement Dining Facility, 18th Personnel Group, Fort Bragg, NC. c. He was honorably released from acrive duty on 14 September 1996. His DD Form 214 shows he completed 4 years, 8 months, and 8 days of active service. It also shows in: * Block 12 f (Foreign Service) 0000-00-00 * Block 13, Army Lapel Button, Army Achievement Medal (3rd Award), Army Good Conduct Medal, National Defense Service Medal, Humanitarian Service Mredal, NCO professional Development Ribbon, Army Service Ribbon, Expert Marksmanship Badge with Rifle Bar, and Parachutist Badge * Block 18 (Remarks) no entry showing service in Haiti 4. There are no documents in his service record that establish his exacts dates of service and/or the duration of his service in Hahit. He provides the following: a. A Certificate of Achievement, 17 January 1995, Uphold Democracy – Joint Task Force Haiti. The certificate does not list his date sof service in Haiti. b. A Certifiacte of Achievement, undated, Combined Jont Task Forec 180 – Haiti, that’s tates he contributed to the success of Operation Maintain Democracy and Uphold Democracy in Haiti. The certificate does not list his date sof service in Haiti. c. A Certifiacte of Achievement, undated, Combined Jont Task Forec 180 – Haiti, Multi-National Force Certificate of Paricipation. The certificate does not list his date sof service in Haiti. 5. His service record contains a Memorandum, 14 November 1995, issued by the Joint Staff that appproves award of the “Humanitarian Service Medal (HSM) for those personnel assigned to JTF 180, JTF 190, and the Multinational Force Haiti, during Operation Uphold/Restore Democracy. The award of the HSM has been approved for those Service members who provided this humanitarian assistance and were assigned to the operation during the period 10 September 1994 to 31 March 1995.” Attached to the memorandum is a list of names that included the applicant’s name, although his exact dates of service in Haiti are not listed. 6. By regulation (AR 635-5), the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. * Block 12f, enter total amount of foreign service completed during the period covered by the DD Form 214 and is obtained from the Soldier's records * Block 13, awards, and decorations from all periods (Certificates of Achievement are not entered) * Block 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (Name of County Deployed) FROM (inclusive dates for example, YYYYMMDD- YYYMMDD)." 7. By regulation (AR 600-8-22), the Armed Forces Expeditionary Medal is authorized for qualifying service after 1 July 1958 in military operations within a specific geographic area during a specified time period. An individual who was not engaged in actual combat or equally hazardous activity must have been a bona fide member of a unit participating in or be engaged in the direct support of the operation for 30 consecutive or 60 nonconsecutive days provided this support involved entering the area of operations. Qualifying service for this award includes Haiti for Operation Uphold Democracy from 16 September 1994 to 31 March 1995. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the applicant's military records, the Board found that relief was not warranted. The applicant's contentions, his military records, and regulatory guidance were carefully considered. Although he provides evidence of participation in Operation Uphold Democracy in Haiti, the certificates do not establish the exact dates he arrived in or departed from Haiti. If the applicant has additional documents to confirm those dates (such as an award recommendation, a completed travel voucher, Leave and Earnings Statements showing receipt of hostile fire pay), he can resubmit his application to this Board for reconsideration. ? Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medal, service medals and ribbons, combat and special skill badges and tabs, unit decorations, and trophies, and similar devices awarded in recognition of accomplishments. The Armed Forces Expeditionary Medal is authorized for qualifying service after 1 July 1958 in military operations within a specific geographic area during a specified period. An individual who was not engaged in actual combat or equally hazardous activity must have been a bona fide member of a unit participating in or be engaged in the direct support of the operation for 30 consecutive or 60 nonconsecutive days provided this support involved entering the area of operations. Qualifying service for this award includes Haiti for Operation Uphold Democracy from 16 September 1994 to 31 March 1995. 3. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. Chapter 2 contains guidance on the preparation of the DD Form 214.
