IN THE CASE OF: BOARD DATE: 5 December 2022 DOCKET NUMBER: AR20220006741 APPLICANT REQUESTS: a correction to his social security number (SSN) to reflect on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Social Security Card FACTS: 1. The applicant did not file within the three-year time frame provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, a typo on his DD Form 214 was made by the military. 3. The applicant provides a copy of his Social Security Card, which shows his SSN as 4. A review of the applicant’s service record shows: a. He was inducted in the Army of the United States on 12 August 1963. b. DA Form 24 (Service Record) reflects the applicant’s Social Security Account Number (SSAN) as c. DA Form 20 (Enlisted Qualification Record), reflects the applicant’s SSAN as d. Office of The Adjutant General Annual Training Order 07-293437, dated 24 July 68, reflects the applicant’s SSAN as e. His DD Form 214 (copy 2) shows he was honorably discharged on 27 July 1965 and transferred to the U.S. Army Reserve, under the provisions of Army Regulation 635-205, paragraph 7, separation program number (SPN) 411, Early Release Overseas Returnee. He served 1 year, 11 months, and 16 days of net service this period. It also shows in item 32 (Remarks) his SSAN, overtyped, as f. His DD Form 214 (copy 5), item 32 (Remarks) shows a distinct, overtyped SSAN 5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created. The Board determined there was sufficient evidence to grant relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 27 July 1965 by showing the social security number listed on his DA Form 24 (Service Record) and his social security card, I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
