The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, her discharge date on her DD Form 214 reflects “22 February 1997,” which is incorrect and should reflect “25 February 1997.” Also, her last pay grade was “specialist4 (SP4)/E-4,” not “private2 (PV2/E-2).” When she enlisted, her last name was Since then, she has remarried and her last name is now 3. The applicant provides: a. Honorable Discharge certificate, which certifies that shespecialist (SPC), U.S. Army Reserve (USAR) was honorably discharged from the U.S. Army on 25 February 1997. b. Two LESs, covering the periods of 1-30 November 1990 and 1-31 December 1990, show an emphasis (circled) on item 3 (Pay Grade) “E3.” 4. A review of the applicant’s service record shows: a. She enlisted in the Army Reserve on 23 February 1989, for eight years. b. DA Form 2-1 (Enlisted Qualification Record) shows the following: (1) Item 18 (Appointments and Reductions) * PV1, USAR, 23 February 1989 * PV2, USAR, 9 September 1989 * PFC, USAR, 7 November 1990 * SPC, USAR, 6 May 1991 (2) Item 32a (Ready Reserve Obligation Expiration Date): 22 February 1997 (3) Item 35 (Record of Assignments) * 19 June 1990, Advanced Individual Training (AIT), Fort Eustis, VA * 2 November 1990, Attack Helicopter Repairer (USAR-Ready), Greencastle, PA c. DD Form 214 shows she was honorably released from active duty training and transferred to her USAR unit in Greencastle, PA on 2 November 1990 under the provisions of Army Regulation (AR) 635-200 (Personnel Separations – Enlisted Personnel), chapter 4, expiration term of service. She served 4 months and 9 days of net active service this period. It also shows the following: * Item 4a (Grade, Rate or Rank): PV2 * Item 4b (Pay Grade): E-2 * Item 6 (Reserve Obligation Termination Date): 22 February 1997 * Item 12b (Separation Date This Period): 2 November 1990 5. AR 635-5 (Personnel Separations – Separation Documents) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214. ? BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board determined the applicant is seeking to have her reserve component time included on her DD Form 214 which is after her active-duty period. Furthermore, the Board found the applicant was promoted to SPC/E-4 on 7 November 1990 which was after her active-duty period ended on 2 November 1990. Based on this, the Board denied relief. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. a. Paragraph 2-2 states, personnel officers will use the DA Form 201 (Military Personnel Records Jacket, MPRJ), DA Form 2 and 2-1 (Personnel Qualification Records), Separation Orders, DD Form 4/4 (Enlistment/Reenlistment Document – Armed Forces of the United States, DA Form 3716 (Personnel Financial Record), Enlistment records and DD Forms 214 for prior service personnel, and any other available records when preparing DD Form 214WS (Worksheet). b.
