Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100012161, on 16 November 2010. 2. The applicant states he was requested to get a new SSN because it was reported to him that other people were already using his old/original SSN for employment purposes. He now needs an updated DD Form 215 (Correction to DD Form 214) with the new SSN and to apply for assistance with nursing. 3. The applicant provides his 2021 Form SSA-1099, Social Security Benefits Statement, reflective of a name similar to his, with the SSN as SSN 4. Review of the applicant’s service records shows: a. The applicant enlisted in the Regular Army on 3 June 1975. Item 1 (Service Number/SSAN) of his DD Form 4 (Enlistment Contract - Armed Forces of the United States) shows his SSN as b. His DA Form 2-1, Personnel Qualification Record, which was created upon his entry on active duty, also listed his SSN as . c. His service record contains multiple documents, including a DD Form 1584 (National Agency Check Request) which also shows his SSN as when his initial National Agency Check was completed on 5 March 1975. d. The applicant's military personnel records show the contested SSN was used consistently in the publication of his military orders and related documents, to include a DA Form p873 (Certificate of Clearance and/or Security Determination under Executive Order 10450). e. He was discharged on 19 August 1977, under the expeditious discharge program. Item 3 (SSN) of this DD Form 214 shows the SSN f. In his previous application, the applicant submitted an SSA benefit information sheet, dated 25 March 2010, showing his SSN as g. On 16 November 2010, the Board considered his petition to change his SSN and denied it. The Board determined: (1) The applicant contends that his SSN should be corrected to show on his DD Form 214 because the SSA changed his SSN due to identity theft. Additionally, he contends he needs his current SSN on his DD Form 214 so he can receive medical care at a VA hospital. (2) The original SSN verification document used to prepare his initial DD Form 4 when he enlisted in the Regular Army is not available for review. However, his DD Form 4 shows his SSN as and this SSN is used on documents within his OMPF throughout his period of service, to include his DD Form 214. (3) For historical purposes, the Army has an interest in maintaining the accuracy of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. There is a reluctance to recommend that those records be changed. While it is understandable the applicant desires to now record his current SSN in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Army's records at this late date. (4) The applicant is advised that a copy of this decisional document along with his application and the supporting evidence he provided which confirms his current SSN will be filed in his official military personnel file (OMPF). This should serve to clarify any questions or confusion concerning the difference in his SSN recorded in his military record and to satisfy his desire to have his current SSN documented in his OMPF. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The Board agreed that there was insufficient evidence to change his SSN on his DD Form 214. The applicant consistently used the contested SSN throughout his military service. He did not use the requested SSN at any time during the period covered by his DD Form 214. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created, unless there is sufficient evidence that shows a material error or injustice. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers at the time of retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214.
