APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the requested awards were omitted. He has copies of the orders. 3. Review of the applicant’s service records shows: a. He enlisted in the Regular Army on 15 June 1984 and reenlisted on 8 March 1988. He held military occupational specialty 68J, Aircraft Instrument Repairman. b. He served in a variety of stateside or overseas assignments, including Germany and he attained the rank/grade of sergeant (SGT)/E-5. c. He was honorably discharged on 7 August 1991 at the expiration of his term of service. His DD Form 214 shows he completed 7 years, 1 month, and 23 days of active service. It also shows he was awarded or authorized: * Army Service Ribbon * Good Conduct Medal (2nd Award) * National Defense Service Medal * Overseas Service Ribbon * Aircraft Crewman Badge Driver’s Badge * NCO Professional Development Ribbon * Expert Badge with Rifle Bar * Sharpshooter Badge with Grenade Bar 4. The applicant’s service record does not contain, and the applicant does not provide the general or permanent orders that awarded him the Army Commendation Medal and two awards of the Army Achievement Medal. 5. By regulation (AR 600-8-22), awards of the Army Commendation Medal and Army Achievement Medal require a formal recommendation, approval through the chain of command, and announcement in orders. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. By regulation (AR 600-8-22), awards of the Army Commendation Medal and Army Achievement Medal require a formal recommendation, approval through the chain of command, and announcement in orders. If the applicant has copies of the permanent or general orders awarding him these awards, he may reapply to this Board for reconsideration. ? Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medals, service medals and rib-bons, combat and special skill badges and tabs, unit decorations, trophies, and similar devices awarded in recognition of accomplishments. It states: a. The Army Commendation Medal may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguishes himself or herself by heroism, meritorious achievement, or meritorious service. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. b. The Army Achievement Medal is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement.
