IN THE CASE OF: BOARD DATE: 7 March 2023 DOCKET NUMBER: AR20220008271 APPLICANT REQUESTS: reconsideration of his previous request for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), Block 18 (Remarks) to add his "Dual Component Status." APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Previous Record of Proceedings FACTS: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20200006160 on 27 September 2021. 2. The applicant states he requests the Board reconsider his request. He never intended to petition for a change to his DD Form 214, Certificate of Release or Discharge from Active Duty, (Block 4a/4b). In retrospect, the intent of his petition was to request that Block 18 (Remarks) be amended (or as appropriate) to add his "Dual- Component Status" to his DD Form 214. He concurs that his rank and grade are correct on his DD Form 214, at his retirement on June 30, 1993, which show his Active-Duty Rank and Grade of CW4/W04. a. In his 29 February 2020, cover letter, he stated his request was chiefly for posterity's sake. He was trying to say that when future generations, family members, and others look at one's military service, usually what is made available for review is their DD Form 214. In his experience, the official military personnel file is not available in most situations. The DD Form 214 should be as reflective or inclusive of a service person's achievements as possible. In other words, assignments, awards, and most training schools are listed on the DD Form 214. That is why he feels that it should be appropriate to acknowledge and record his dual component status on his DD Form 214. b. As acknowledged in Para 4 (c) of the ABCMR Record of Proceedings dated September 27, 2021, as of May 1982, he was in a Control Group, Dual Component Status, for individuals who had status in both the Active Army and the Army Reserve. He held the rank of Captain, then the rank of Major, as of May 31, 1989, in the Reserve Component. As a result of his Dual Component Status, he was awarded the Armed Forces Reserve Medal, which is listed on his DD Form 214, block 13. Ironically, however, his Dual Component Status is not recorded on my DD Form 214. He requests Block 18 (Remarks) section of his DD Form 214 be amended (or appropriately) to add my "Dual Component Status." He makes a suggestion to add the statement: “Dual Component Status Control Group (Active Army/ Army Reserve) From June 1, 1982, to June 30, 1993: USAR, Captain May 31, 1982, USAR, Major May 31, 1989. 4. Review of the applicant’s military records show: a. He was appointed as a Regular Army (RA) warrant officer one and executed an oath of office on 20 August 1976. He served in a variety of stateside or overseas assignments. He was promoted to CW3 on 1 May 1982. b. On 1 June 1982, he executed an oath of office and was also appointed as a Reserve commissioned officer in the rank of captain, on 1 June 1982. c. He continued his service in the Regular Army while at the same time, he held a Reserve commission. d. On 23 December 1982, the U.S. Army Reserve Components Personnel and Administration Center, St. Louis issued him a “Dual Component Status” Memorandum. It addresses him as a CW3 and states “In order to assist you and ensure your progression as a Reserve officer, this Center has established a Control Group (Dual Component) in accordance with AR 600-39. As an active Army member holding a Reserve commission you have been identified as a member of this group of individuals who have status in both the Active Army and the Army Reserve.” e. On 5 June 1989, the U.S. Total Army Personnel Command issued him a Promotion as a Reserve Commissioned Officer Memorandum informing hm he was promoted to the Reserve commissioned officer grade of Major on 31 May 1989. The memorandum stated he is a CW3 serving on active duty as a CW3. f. He was promoted to the Regular Army grade of CW4 on 1 May 1989. g. He was honorably retired on 30 June 1993. His DD Form 214 shows he completed over 26 years of active service. It also shows in: * Blocks 4a (Grade, Rate, or Rank) and 4b (Pay Grade) CW4 and W4 * Block 12h (Effective Date of Pay Grade) 1 May 1989 * Block 18 (Remarks) listed mandatory entries and continuation entries g. On 27 September 2021, the Board considered his application regarding his grade. After reviewing the application and all supporting documents, the Board found that relief was not warranted. Board members noted that the DD Form 214 shows the active duty rank/pay grade at time of separation and item 12f shows the effective date of the rank/pay grade. The applicant held the active duty ran of CW4, not MAJ at the time of retirement. There is no error or injustice. 5. By regulation (AR 635-5), the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. The information entered thereon reflects the conditions as they existed at the time of separation. The Remarks block is used for: * Entries required by Headquarters, Department of the Army entries * Entries that are too long for their blocks BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence shows the applicant served in a dual component. As an active Army member holding a Reserve commission, he was identified as a member of a group of individuals who have status in both the Active Army and the Army Reserve. He retired as an active Army warrant officer and his DD Form 214 reflects his correct component and grade at the time of retirement. There is no provision in the regulation that governs the DD Form 214 to list a dual component warrant/commissioned officer in the Remarks block. ? Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. It also stated: * Blocks 4a (Grade, Rate, or Rank) and 4b (Pay Grade) – would list the active duty rank/pay grade at time of separation * Block 12h (Effective Date of Pay Grade) – would list the effective date of the rank/pay grade in items 4a and b * Block 18 (Remarks), Use this block. for entries required by HQOA for which a separate block is not available and for completing entries that are too long for their blocks. Make the following entries, if applicable: * Reenlistments of enlisted Soldiers * Retirement for length of service * Transfer to the Individual Ready Reserve * Delayed Entry Program Time * Extension and/or Retention in service * Retired list advancement * Dual componency retired grade (for enlisted Soldiers only) * Severance readjustment, or non-disability severance pay * Excess leave, Enlistment/Reenlistment Bonus * Alien Deserter, Cadet Status, Temporary Record * Upgraded Discharge, Prisoner of War //NOTHING FOLLOWS// ABCMR Record of Proceedings (cont) AR20220008271 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS 1
