The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his third digit in his social security number (SSN) should be. The incorrect number is causing problems with Internal Revenue Services, Social Security, and Veterans Affairs having incorrect information. 3. The applicant enlisted in the U.S. Army Reserve (USAR) on 9 May 1979. His DD Form 4 (Enlistment/Reenlistment Document) reflects the contested SSN. 4. His DD Form 1966 series (Application for Enlistment – Armed Forces of the United States) reflects the contested SSN 5. All other military records reflect the contested SSN. 6. He entered a period of active-duty training (ADT) on 22 May 1979. He was honorably released from ADT on 25 October 1979, upon completion of military occupational specialty training. 7. Orders D-05-031334, issued by U.S. Army Reserve Personnel Center, St. Louis, MO, on 8 May 1985, shows the applicant was honorably discharged from the USAR on 8 May 1985. His orders reflect the contested SSN. 8. The applicant provides: SS Card & Driver's License: his SS card reflects the requested SSN and Request for Transcript of Tax Return which reflects the requested SSN. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence of record shows the applicant used an SSN that contains the number . He states it should be. However, there is no evidence in his records he used the requested SSN at any time during his military service. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created, unless there is sufficient evidence that shows a material error or injustice. The evidence of record shows the applicant used the contested name during his entire period of service. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. ? Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 635-5 (Separation Documents) states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation.
