The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he was mobilized from the Individual Ready Reserve (IRR) for Desert Storm/Desert Shield. He was sent to Fort Eustis, VA to in-process, then was sent to Fort Dix, NJ to do more in-processing, then was sent to Fort Jackson, SC and was issued weapons and gear, and then sent to Kuwait. Once in Saudi Arabia, he was then transported via C-130 to King Khalid Military City (KKMC) and was assigned to 628 Transportation (Forward), 553rd Combat Support Battalion, 3rd Armored Cavalry Regiment. He never received recognition for his service in Desert Storm/Desert Shield and never received any awards or medals associated with his time in Desert Storm/Desert Shield. 3. The applicant enlisted in the Regular Army on 5 October 1984. He served honorably on active duty from 30 July 1985 to 29 April 1988. 4. He enlisted in the New York Army National Guard on 29 August 1988 for a period of 4 years and 5 weeks. He was ordered to active duty by executive order dated 18 January 1991. He reported to Fort Dix, NJ for active duty. His DA Form 2-1 shows he was transferred to Fort Steward, GA on 11 February 1991. 5. The applicant was honorably released from active duty on 11 April 1991 and transferred to the IRR. He was credited 2 months 12 days net active service this period. His DD Form 214 shows in: * Block 12f (Foreign Service) 0000-00-00 * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) Army Achievement Medal, Good Conduct Medal, National Defense Service Medal, Army Service Ribbon, and Driver and Mechanic Badge * Block 18 (Remarks) shows ordered to active duty in support of Operation Desert Shield/Desert Storm; however, there are no dates listed 6. The applicant provided a copy of Orders S-69-1 showing he his reassignment from 628th Transportation Company, 13th Corps Support Command, Fort Hood, TX to 21st Replacement Detachment, 3rd Personnel Group, Fort Hood, TX effective 5 April 1991 for the purpose of demobilization. 7. A DD Form 215 (Correction to DD Form 214) was issued 16 December 1991 correcting his reserve obligation, place of entry, home of record, last duty assignment, station where separated, prior active and inactive service, effective date of grade, addition of awards (Expert Marksman Badge, Grenade and Sharpshooter Marksman Badge, M-16), and administratively required entries for block 18. 8. Officials at the Defense Finance and Accounting Service (DFAS) were unable to locate documentation regarding the applicant’s mobilization. 9. His name is shown on the Gulf Roster as having served in Southwest Asia from 1 March 1991 to 5 April 1991, a period of 1 month and BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The applicant’s name is shown on the Gulf Roster as having served in Southwest Asia from 1 March 1991 to 5 April 1991, a period of 1 month and 6 days. This qualifies him for a correction to his DD Form 214 to show his foreign service/deployment, as well as awards of the Southwest Asia Service Medal with one bronze service star and the two Kuwait Liberation Medals. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states: a. The Southwest Asia Service Medal is awarded to members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over, on or after 2 August 1990 to 30 November 1995. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January to 11 April 1991) * Cease-Fire Campaign (12 April 1991 to 30 November 1995) b. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. c.
