The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his officer candidate school and advanced course at Fort Benning, GA, were in the Infantry Branch. His two voluntary combat tours were while he was assigned to the Infantry Branch. All of his service and training is Infantry Branch related. 3. His service record is void of orders assigning him to the Infantry Branch. 4. The applicant was appointed as a Reserve commissioned officer and entered active duty on 25 June 1963. His DA Form 66 (Officer Qualification Record) shows his military occupational specialties: * 1542, Parachute Course on 25 June 1963 * 1542, Infantry Unit Commander on 25 June 1963 * 2900, Headquarters Unit Commander on 10 June 1964 * 2110, Adjutant General on 17 February 1972 * 2625, Logistics Officer, 2 November 1973 5. On 20 July 1972, he requested a branch transfer to the Quartermaster Corps as an exception to policy. His signature block shows his then-branch as Infantry. 6. The U.S. Army Reserve Components Personnel and Administration Center 1st endorsement, 11 September 1972, with attached U.S. Army Reserve Components Personnel and Administration Center Letter Orders Number 08-33391, 31 August 1972, relieved him from the Infantry Branch and transferred him to the Quartermaster Corps effective 31 August 1972. 7. Item 12 (Appointments) of his DA Form 66 (Officer Qualification Record) shows he was transferred from the Infantry Branch to the Quartermaster Corps effective 31 August 1972. 8. Headquarters, Support Activity, Worms, Germany, memorandum (Voluntary Retirement), 27 March 1974, shows he requested relief from active duty effective 31 August 1974 and placement on the Retired List effective 1 September 1974. His signature block shows his then-branch as Quartermaster Corps. 9. Headquarters, U.S. Army Europe and Seventh Army, Special Orders Number 107, 17 April 1974, as amended by Special Orders Number 161, 10 June 1974, reassigning him to the U.S. Army Training Center and Fort Jackson effective 10 August 1974, show his branch as Quartermaster Corps. 10. His DA Form 3713 (Data for Retired Pay), 10 July 1974, shows his branch as Infantry. 11. U.S. Army Military Personnel Center Letter Orders Number S7-163, 10 July 1974, retiring him effective 31 August 1974, show his branch as Infantry. 12. Headquarters, U.S. Army Training Center and Fort Jackson, Special Orders Number 143, 16 July 1974, transferring him to the U.S. Army Transfer Station for separation processing effective 30 August 1974, show his branch as Quartermaster Corps. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the applicant's military records, the Board found that relief was not warranted. The applicant's contentions, his military records, and regulatory guidance were carefully considered. The evidence of record shows the applicant served on active duty from 25 June 1963 to 31 August 1974. The applicant’s DA Form 66 shows he transferred from the Infantry to the Quartermaster Branch on 31 August 1972. Naturally, when he retired, his DD Form 214 listed his branch as Quartermaster. The Board found no error or injustice. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), 23 May 1972, established policies and procedures for completion and distribution of the DD Form 214. a. The general instructions stated all available records will be used as a basis for preparation of the DD Form 214, including the DA Form 66 and orders. b. The specific instructions for item 5 for officer personnel stated to enter "ARMY" in capital letters, also enter the component and basic branch as recorded in items 3 (Component) and 8 (Branch) of the DA Form 66 (e.g., "ARMY-USAR-INF"). If the officer is serving in a branch in which detailed, a cross-reference will be made in item 30 (Remarks) to account for the detail. This information will be obtained from item 24 (Details) of the DA Form 66 (e.g., "Item 4-Inf-detailed TC"). c. The specific instructions for item 16a stated to enter the primary military occupational specialty (MOS) code number, title, and date of award. In addition, enter the primary MOS code evaluation score and date of score. If more space is required, enter "see 30" and continue remark in item 30. If the specialty represented by the MOS has a related civilian occupation, enter the appropriate job title and code from the Dictionary of Occupational Titles in item 16b.
