The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the SSN annotated on his DD Form 214 belongs to another veteran named. He would like his DD Form 214 amended to reflect his correct SSN of 3. The applicant was inducted into the Army of the United States on 6 January 1965. His DD Form 47 (Record of Induction) shows the following: * his service number was * he was not a U.S. citizen at the time, but a citizen of the country of * his alien registration receipt card number was * the form does not contain a Social Security Number 4. The following documents in the applicant’s service records all reflect his service number as and do not reference a Social Security Number: * Standard Form 88 (Report of Medical Examination), dated 27 August 1965 * DA Form 1811 (Physical and Mental Status on Release from Active Service), dated 4 January 1967 * DA Form 20 (Enlisted Qualification Record) 5. The applicant provided a copy of a Military Pay Voucher covering the pay period 1-11 January 1967, which shows his Service Number as and his Social Security Number as 6. The applicant was honorably released from active duty due to expiration term of service on 11 January 1967 and transferred to the U.S. Army Reserve (USAR) Control Group (Annual Training), item 2 (Service Number) reflects. Item 32 (Remarks) shows the applicant’s SSN as 7. U.S. Army Administration Center Letter Orders – E, dated 13 March 1968, show the applicant was given a general, under honorable conditions discharge from the USAR Control Group (Annual Training) effective 13 March 1968. His Service Number is reflected on the orders as and his SSN is reflected as. 8. There are no documents in the applicant’s available service records reflecting his SSN as 9. The applicant provided the following documents, both of which reflect his SSN as * U.S. District Court, Federal Pretrial Services Agency, Request for Military Service Data, dated 28 November 1977 * Social Security Card BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was/was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence of record shows the applicant consistently used the contested SSN. There is no evidence in his records he used the requested SSN at any time during his military service. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created, unless there is sufficient evidence that shows a material error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers at the time of retirement, discharge, or release from active duty service or control of the Active Army and established standardized policy for preparing and distributing the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). The general instructions stated all available records would be used as a basis for preparation of the DD Form 214.
