The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, the separation date on her DD Form 214, ending 3 June 2011, should match the effective date of 13 March 2018, reflected in Orders 18-065-00037, dated 6 March 2018. She also feels her DD Form 214 should be corrected to add the Army Achievement Medal and Army Reserve Component Achievement Medals that were awarded to her so she will be honored properly upon her death. 3. The applicant enlisted in the U.S. Army Reserve (USAR) on 6 February 2010. 4. Her DD Form 214 confirms she entered onto initial active duty for training to complete basic combat and advanced individual training, and upon the completion of training she was transferred back to her USAR unit. Her DD Form 214 contains the following entries: * 12a (Date Entered Active Duty This Period - 4 January 2011 * 12b - 3 June 2011 * 12c (Net Active Service This Period) - 5 months * 23 (Type of Separation) - Release from Active Duty for Training (ADT) 5. There is no evidence she performed any periods of active duty after the date she was released from ADT on 3 June 2011 that would have warranted the issuance of a DD Form 214. 6. A DA Form 638 (Recommendation for Award), dated 16 June 2011, shows Permanent Orders 11-167-11, dated 16 June 2011, awarded the Applicant the Army Achievement Medal for Achievement during the period 6 June 2011 to 19 June 2011. 7. A Memorandum for Record, Subject: Award of the Army Reserve Component Achievement Medal for applicant, dated 22 February 2017, and signed by her commander, which states the applicant was awarded the Army Reserve Component Achievement Medal for the following periods: * Army Reserve Component Achievement Medal (1st Award) - 6 February 2010 to 5 February 2013 * Army Reserve Component Achievement Medal (2nd Award) - 6 February 2013 to 5 February 2016 8. Orders 18-056-00037, published by Headquarters, 81st Readiness Division, Fort Jackson, SC, dated 6 March 2018, honorably discharged the applicant from the USAR, effective 13 March 2018. 9. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge, and is not intended to have any legal effect on termination of a Soldier's service. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence of record shows the applicant served in the USAR from 6 February 2010 to 13 March 2018. During this USAR service, she entered active duty or training from 4 January 2011, and she was released from active duty on 3 June 2011. The discharge date of 13 March 2018 is the date she was discharged from the Reserve, not the date she was released from active duty. The awards she received were awarded after her release from active duty and for actions/service not related to her active duty for training. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. a. A DD Form 214 will be prepared for Reserve Component (RC) Soldiers completing 90 days or more of continuous ADT, Full-Time National Guard Duty, active duty for special work, temporary tours of active duty, or Active Guard Reserve service. Also, RC Soldiers separated for cause or physical disability regardless of the length of time served on active duty. Additionally, a DD Form 214 will be completed for RC Soldiers completing initial ADT that results in the award of an MOS even when the active duty period was less than 90 days. This includes completion of advanced individual training under the ARNG of the United States Alternate Training Program or USAR Split Training Program. b. This regulation provides the following guidance for making entries on the DD Form 214, and provides: (1) block 12b, Separation Date This Period, enter the Soldier’s transition date. This date may not be the contractual date if Soldier is separated early, voluntarily extends, or is extended for make up of lost time, or retained on active duty for the convenience of the Government. (2) block 13 - list awards and decorations for all periods of service in the priority sequence specified in AR 600-8-22. Each entry will be verified by the soldier’s records.
