APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: * DD Form 214 * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant served a qualifying period of service for award of the Global War on Terrorism Service Medal which will be administratively added without action by the Board. The Board will consider his marksmanship badges and any other awards. 3. The applicant enlisted in the Regular Army on 3 January 2006. He successfully completed training and was awarded military occupational specialty 88M (Motor Transport Operator). 4. Evidence shows he served in Iraq from 29 October 2007 to 2 January 2009 and Afghanistan from 17 February 2010 to 10 February 2011. 5. On 16 March 2012, he was honorably discharged in the rank of private first class after completing 6 years, 2 months, and 14 days of active military service with no lost time. The DD Form 214 he was issued shows he was awarded or authorized the: * Afghanistan Campaign Medal with Campaign Star * Iraq Campaign Medal with 2 Campaign Stars * Army Commendation Medal * Army Achievement Medal * Army Good Conduct Medal * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon (2nd Award) * North Atlantic Treaty Organization Medal * Combat Action Badge * Driver and Mechanic Badge with Driver-Wheeled Vehicle Clasp 6. His records contains a DA Form 2627 (Record of Proceedings Under Article 15, Uniform Code of Military Justice) which shows he was assigned to Company A, 626th Base Support Battalion, 3rd Brigade Combat Team, 101st Airborne Division (Air Assault), Forward Operating Base Sharana, Afghanistan on 30 July 2010. 7. Headquarters Department of the Army General Orders Number 2014-46, 10 July 2014, awarded the Valorous Unit Award to Headquarters, 3rd Brigade Combat Team, 101st Airborne Division, to include the 626th Support Battalion, for the period 1 April 2010 to 31 August 2010. 8. There is no evidence in his record and the applicant has not provided sufficient evidence that shows he was awarded any Marksmanship Qualification Badges. 9. Army Regulation 600-8-22 (Military Awards) sets forth requirements for award of basic marksmanship qualification badges. The qualification badge is awarded to indicate the degree – Expert, Sharpshooter, and Marksman, in which an individual has qualified in a prescribed record course. An appropriate bar is furnished to denote each weapon with which the individual qualified with. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records the Board determined the applicant’s record is absent evidence showing awarding him the marksmanship qualification badge. The Board determined the burden of proof rest on the applicant; however he did not provide any supporting documentation and his record has insufficient evidence to support he was awarded the badge. Based on the preponderance of evidence, the Board determined there is insufficient evidence to grant the applicant’s request. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to more accurately depict the military service of the applicant. ADMINISTRATIVE NOTE(S): Make the following administrative correction to the applicant's DD Form 214 for the period ending on 16 March 2012 without action by the Board: add the Global War on Terrorism Service Medal and valorous Unit Award to block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized). REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 sets forth requirements for award of basic marksmanship qualification badges. The qualification badge is awarded to indicate the degree – Expert, Sharpshooter, and Marksman, in which an individual has qualified in a prescribed record course. An appropriate bar is furnished to denote each weapon with which the individual qualified with. 3. Army Regulation 600-8-22 further states the Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty on or after 11 September 2001 to a date to be determined having served 30 consecutive or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. 4.
