Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140003300 on 6 November 2014. 2. The applicant states he is requesting the entry date on active duty be changed to 15 August 1974, that is the day he went to boot camp for training. He believes his service treatment records include the accurate date and are dated prior to the entry date that is listed on his DD Form 214. He notes that he served from 15 August 1974 through 19 December 1974 and the record should be corrected to accurately reflect his military service. 3. The applicant provides as new evidence page 2 of his entrance medical examination which does not include the date identified by the applicant, 15 August 1974. The document is date stamped 24 October 1974. 4. A review of the applicant’s service record shows: a. The applicant enlisted in the U. S. Army Reserve (USAR) under the Delayed Entry Program (DEP) on 24 October 1974. He was discharged from the USAR DEP on 4 November 1974 for immediate enlistment in the Regular Army (RA). He enlisted in the RA on 5 November 1974 for a period of 3 years. b. The applicant was honorably discharged in his fifth week of basic training under the provisions of a Department of the Army Message, dated 1 August 1973, subject: Evaluation and Discharge of Enlistees Before 180 Active Duty Days. c. The applicant's DD Form 214 shows: • a date of entry onto active duty of 5 November 1974 • a date of discharge of 19 December 1974 • 1 month and 15 days of net active service with 10 days of inactive service d. His DA Form 2-1(Personnel Qualification Record) confirms the dates as shown on his DD Form 214. 5. On 6 November 2014, the Board denied his request to change the entry date. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was/was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence of record shows the applicant enlisted in the USAR under the Delayed Entry Program (DEP) on 24 October 1974. He was discharged from the USAR DEP on 4 November 1974 for immediate enlistment in the Regular Army (RA). Enlisted Soldiers first enter the DEP as inactive reservists, then make a commitment to report for training on a specified date. However, they do not become active duty servicemembers until they formally enlist as such on that date. The applicant enlisted in the RA on 5 November 1974 for 3 years. The date 5 November 1974 is the date he entered active duty. He was discharged on 19 December 1974, after completing 1 month and 15 days of net active service with 10 days of inactive service. Based on the preponderance of the evidence, the date of entry shown on his DD Form 214 is not in error or unjust. REFERENCES: 1. Army Regulation 15-185 (ABCMR) sets forth procedures for processing requests for the correction of military records. Paragraph 2-15a governs requests for reconsideration. This provision of the regulation allows an applicant to request reconsideration of an earlier decision of the ABCMR if the decision has not previously been reconsidered. The applicant must provide new evidence or argument that was not considered at the time of the ABCMR's prior consideration. 2. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214 and states: a. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. b. For item 12a (Date Entered Active Duty (AD) This Period), enter the beginning date of the continuous period of AD for issuance of this DD Form 214, for which a DD Form 214 was not previously issued.
