The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, during his enlistment his last name and SSN were incorrect. He would like to correct this error and be able to request his records with his correct information. He would like to be able to request all of his military records using his correct SSN and name. After his enlistment, he attempted to correct this but was never told the proper way to do so. He spoke to a Veteran Advocate and was instructed to submit a DD Form 149 to the Board. 3. The applicant's service record contains the following documents for the Board's consideration: a. DD Form 4 (Enlistment Record - Armed Forces of the United States), dated 13 April 1966, which shows the applicant's name as "GXXXX." The form does not include the applicant's SSN. b. DA Form 20 (Enlisted Qualification Record), which shows his name in item 1 (Name) as "GXXXX" and his SSN as "XXX-XX-XXXX." c. DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), for the period ending 26 March 1969 which shows in item 1 (Last Name Fist Name-Middle Name) his last name as "GXXXX" and his SSN as "XXX-XX-XXXX." 4. The applicant provides the following documents for the Board's consideration: a. A copy of his identification tag which shows his name as "GXXXX" and his SSN as "XXX-XX-XXXX." b. A copy of his birth certificate which shows his name as "GXXXX." c. A copy of his Social Security Card, which shows his SSN as "XXX-XX-XXXX." d. The applicant did not provide documentation showing his legal name as "GXXXX." BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is not warranted. 2. The Board found the applicant s SSN was correctly recorded in his service record. The only item that contains an error in the SSN is his identification tag, which was no longer in use once he was released from active duty. The Board determined there is no basis for correcting the identification tag. 3. The Board found the applicant s last name was spelled as shown on his DD Form 214 throughout his period of military service. The Board found insufficient evidence of mitigating factors that would be a basis for changing entries in the applicant s service records that accurately reflect the information that was available at the time the records were completed. The Board determined the last name in the applicant s records should not be changed. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations Separation Documents), in effect at the time prescribes the separation documents which are prepared for individual upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214. All available records will be used as a basis for preparing DD Form 214 to include DA Form 20 and orders.
