The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he needs his record corrected as evidence to support an ongoing Department of Veterans Affairs disability claim. 3. The applicant enlisted in the Regular Army on 10 May 1983. He completed training and served in military occupational specialty 11B (Infantryman). 4. On 9 March 1987, he was honorably released from active duty at the expiration of his term of service. The DD Form 214 he was issued shows he was awarded or authorized the: • Parachutist Badge • Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M16) • Sharpshooter Marksmanship Qualification Badge with Grenade Bar • Army Service Ribbon • Army Good Conduct Medal • Noncommissioned Officer Professional Development Ribbon • Army Lapel Button • Expert Infantryman Badge • Jungle Expert Badge 5. The applicant provides a/an: a. Citation and certificate for the JSAM awarded to the applicant on 9 December 1986 for exceptional meritorious achievement during the period 13 January 1986 to 25 February 1986 in support of forensic pathology. Orders are not present and are not provided by the applicant.. b. Letter from the Chief, Boards Section Military Awards Branch, U.S. Army Military Personnel Center, 20 January 1987, authorizing acceptance and wear of the British Parachutist Badge. c. Certificate entitling wear of British Parachutist Wings effective 3 October 1986. 6. Army Regulation 600-8-22 (Military Awards), paragraph 9-26d., addresses foreign badges and official records. The approved memorandum for acceptance and wear of foreign badges endorsed by the first general officer in the chain of command or U.S. Army Human Resources Command, Awards and Decorations Branch to include a copy of the certificate and its supporting documents will be entered in the Army Military Human Resource Record of the recipient. The British Army Parachute Badge is listed in appendix D. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is warranted. 2. The Board found the certificate and citation for the JSAM and the authorization letter and certificate for the British Army Parachute Wings provided by the applicant sufficient to confirm he was authorized the medal and the badge. The Board determined these decorations should be added to his DD Form 214. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states: a. The Joint Service Achievement Medal was authorized by the Secretary of Defense on 3 August 1983. It is awarded to members of the Armed Forces of the United States below the grade of O-6 who, after 3 August 1983 distinguished themselves by meritorious achievement or service. The prescribing directive, including processing instructions and approval authorities, for the Joint Service Achievement Medal is Department of Defense Manual 1348.33, Volume 4. b. Paragraph 9-26d., addresses foreign badges and official records. The approved memorandum for acceptance and wear of foreign badges endorsed by the first general officer in the chain of command or U.S. Army Human Resources Command, Awards and Decorations Branch to include a copy of the certificate and its supporting documents will be entered in the Army Military Human Resource Record of the recipient.
