IN THE CASE OF: BOARD DATE: 19 September 2023 DOCKET NUMBER: AR20230001871 APPLICANT REQUESTS: reconsideration of his previous request to correct his Social Security Number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), ending on 26 May 1971 from "XXX-XX-XXXX" to "XXX-XX-XXXX." APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: • DD Form 149 (Application for Correction of Military Record) • Copy of Social Security Card FACTS: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080007892 on 4 November 2008. 2. The applicant states, in effect, his SSN is incorrect on his DD Form 214. The error was made when the DD Form 214 was issued to him. He was unaware of the error and did not review the DD Form 214 upon receipt. 3. On 4 November 2008 (ABCMR Docket Number AR20080007892), regarding the applicant’s request for correction of the SSN shown on his DD Form 214, the Board found the evidence presented did not demonstrate the existence of a probable error or injustice. The Board determined that the overall merits of the case were insufficient as a basis for correction of the records of the applicant. 4. The applicant's service record contains a DD Form 4 (Enlistment/Reenlistment Contract - Armed Forces of the United States), dated 17 April 1969; Standard Form 88 (Report of Medical Examination), dated 17 April 1969; DA Form 20 (Enlisted Qualification Record); and DD Form 214, dated 26 May 1971 all of which show his SSN as "XXX-XX-XXXX." 5. The applicant provides a copy of his Social Security Card, which shows his SSN as "XXX-XX-XXXX." BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was not warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. The evidence of record shows the applicant used the contested SSN during his entire period of service. All documents in his record show he used the contested SSN. There is no evidence the applicant used the requested SSN during his military service. The Army has an interest in maintaining the integrity of its records for historical purposes. The information in those records must reflect the conditions and circumstances that existed at the time the records were created, unless there is sufficient evidence that shows a material error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20080007892 on 4 November 2008. 9/19/2023 I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time prescribes the separation documents which are prepared for individual upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214. All available records will be used as a basis for preparing DD Form 214 to include DA Form 20 and orders. Item 3; transcribe social security account number from DA Form 2139 (Military Pay Voucher). //NOTHING FOLLOWS//
