The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the person typing the DD Form 214 misunderstood his actual name and typed the name they knew him by. 3. The applicant was inducted in the Army of the United States on 10 June 1969. His DD Form 47 (Record of Induction) shows the contested first name. 4. An Acknowledgement of Service Obligation, dated 10 June 1969, shows the contested first name and the applicant signed his name as such. Additionally, his fingerprint card shows the contested first name and he signed his name as such. Special Orders 112 (active-duty orders) also show the contested first name. 5. The applicant completed a DA Form 428 (Application for Identification Card) on 13 June 1969, showing the contested first name and he signed his name as such. 6. The applicant was honorably discharged on 15 June 1969 for immediate reenlistment in the Regular Army. His DD Form 214 shows the contested first name and he signed his name as such. 7. The applicant enlisted in the Regular Army on 16 June 1969 for 3 years. His DD Form 4 (Enlistment Contract – Armed Forces of the United States) shows the contested first name and he signed his name as such. 8. All orders and other related documents in the applicant’s record shows the contested first name. 10. The applicant was honorably released from active duty on 13 January 1972. His DD Form 214 shows the contested first name and he signed his name as such. 11. The applicant provided his social security card and state issued driver’s license showing his legal first name. ? BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is warranted. 2. The Board noted the applicant served using an Anglicized version of his first name. The Board found the evidence sufficient to support adding his legal first name to his DD Form 214. The Board determined the name shown on his driver license should be added to the remarks block of his DD Form 214 as another name of record. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the following entry to item 30 (Remarks) of his DD Form 214: “Other name of record: [name shown on driver license].” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations – Separation Documents) prescribes policy and procedural guidance relating to transition management and explains separation document preparation, to include preparation of the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). The instructions for the completion of item 1 (Name (Last, First, Middle) states, enter last name, first name and full middle name or names, if any.
