The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she deployed to Iraq from 15 April 2003 to 7 April 2004 in support of Operation Iraqi Freedom. She was awarded the Global War on Terrorism Expeditionary Medal, but she would also like the Iraq Campaign Medal. 3. 88th Regional Support Command Orders M022-0063, 22 January 2003, ordered her to active duty as a member of her Reserve Component unit for the purpose of mobilization in support of Operation Enduring Freedom for a period of 365 days with a reporting date of 24 January 2003 4. The 79th Military Police Company Battle Roster, undated, lists Soldiers who were stationed in Kuwait/Iraq between 15 April 2003 and 7 April 2004. The applicant's name is listed. 5. She was honorably released from active duty to the control of her U.S. Army Reserve unit on 9 May 2004. She completed 1 year, 3 months, and 16 days of net active service during this period, including 11 months and 25 days of foreign service. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of her DD Form 214 shows she was awarded or authorized the: * Army Commendation Medal * Army Achievement Medal (3rd Award) * Army Reserve Components Achievement Medal (2nd Award) * National Defense Service Medal * Global War on Terrorism Expeditionary Medal * Global War on Terrorism Service Medal * Armed Forces Reserve Medal * Armed Forces Reserve Medal with "M" Device * Army Service Ribbon * Overseas Service Ribbon * Driver and Mechanic Badge 6. Headquarters, Department of the Army, General Orders 2009-11, 16 December 2009, awarded the Meritorious Unit Commendation to the 79th Military Police Company for exceptionally meritorious conduct in the performance of outstanding service during the period 14 April 2003 to 4 April 2004. BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the applicant's military records, the Board found that relief was not warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board determined based on regulatory guidance that under no condition will personnel receive the Iraq Campaign Medal, Global War on Terrorism Service Medal, Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Armed Forces Expeditionary Medal for the same action, time period, or service. The Board agreed the applicant is not entitled to both awards. Therefore, relief was denied. 2. Prior to closing the case, the Board did note the analyst of record administrative notes below, and recommended the correction is completed to more accurately depict the military service of the applicant. ? ADMINISTRATIVE NOTE(S): The applicant is authorized administrative correction of her DD Form 214 for the period ending 9 May 2004 to show award of the Meritorious Unit Commendation without Board action. ? REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 15-185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army acting through the ABCMR. The ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 3. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Iraq Campaign Medal was awarded to members of the Armed Forces of the United States who served in direct support of Operation Iraqi Freedom between 19 March 2003 and 31 December 2011. Service members must have been assigned, attached, or mobilized to units operating in the area of eligibility for 30 consecutive or 60 nonconsecutive days. The area of eligibility encompasses all land area of the country of Iraq and the contiguous water area out to 12 nautical miles, and all airspaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. One bronze service star is authorized with the Iraq Campaign Medal for participation in each credited campaign. b. The Global War on Terrorism Expeditionary Medal is awarded to service members of the Armed Forces of the United States who are deployed abroad for service in support of the Global War on Terrorism on or after 11 September 2001 to a date to be determined. The general area of eligibility encompasses all foreign land, water, and airspaces outside the 50 states of the United States and outside 200 nautical miles of the shores of the United States. The Global War on Terrorism Expeditionary Medal is only awarded once per named operation, regardless of the number of deployments and periods of service supporting that operation. Effective 9 February 2015 (retroactive to 11 September 2001), separate deployments and periods of service in support of different named operations are recognized by bronze service stars. c. Under no condition will personnel receive the Iraq Campaign Medal, Global War on Terrorism Service Medal, Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Armed Forces Expeditionary Medal for the same action, time period, or service. d. Service members who qualified for the Global War on Terrorism Expeditionary Medal by reason of service between 19 March 2003 and 30 April 2005 in Iraq will remain qualified for that medal.
