Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20210007821 on 19 October 2021. 2. The applicant states she was never promoted to E-4, if so where was her E-4 pay and paperwork. Her DD Form 214 shows E-3 no mention of E-4. She never got pinned, never wore the rank due to cruelty at Fort Hood, TX. She comments about the hard times she went through while at Fort Hood. (The entire letter is available in documents for review). 3. The applicant enlisted in the Regular Army on 5 August 1999. She held military occupational specialty 92G (Food Service Specialist). 4. Her DA Form 2-1 (Personnel Qualification Record) shows in Section III (Service, Training and Other Dates) item 16 (Appointments and Reductions): private first class (PFC) (990805) 5 August 1999. 5. Enlisted Record Brief with a brief date of 2 November 2001, shows: * PFC – (19990805) 5 August 1999 * Specialist (SPC) – (20011005) 5 October 2001 6. Orders 100-0248, issued by Headquarters III Corps, Fort Hood, on 10 April 2002, shows her rank as PFC. 7. She was honorably discharged on 7 May 2002, due to disability, severance pay. Her DD Form 214 shows she completed 2 years, 9 months, and 3 days. It also shows: * Item 4a (Grade, Rate, or Rank): PFC * Item 4b (Pay Grade): E3 * Item 12f (Effective Date of Pay Grade) 1999|08|05 8. Defense Finance Accounting Service provided leave and earnings statements from April and May 2002 show her pay grade as E4. 9. Army Regulation 600-8-19 (Enlisted Promotions and Reductions) prescribes policies and procedures governing promotion and reduction of Army enlisted personnel. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board found there is sufficient evidence to support the applicant’s assertion for correction of her records to show SPC/E-4. Evidence in the record, along with her pay records show she was promoted to SPC/E-4, effective 5 October 2001 and held the rank for a period of 26 months. The applicant’s leave and earning statements supports that she was being paid as E-4. The Board agreed, correction to the applicant’s records is warranted and granted relief. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending her DD Form 214 as follows: correct items 4a (Grade, Rate or Rank) and 4b (Pay Grade) to show his rank/grade as specialist (SPC)/E-4 with a date of rank as 5 October 2001. The AAA-117 and AAA-119 are monthly reports and the official promotion instrument used by commanders to promote to SPC and below. Once the commander indicates denial for promotion on a soldier, this becomes a final action. When the commander denies promotion, he or she may promote the soldier with the next AAA- 117. b. The regulation in effect at the time states in paragraph 2-5a states promotion to PFC and SPC is not automatic and requires the unit commander’s recommendation.
