IN THE CASE OF: BOARD DATE: 2 January 2024 DOCKET NUMBER: AR20230005405 APPLICANT REQUESTS: correction of his retirement points for Retirement Year Ending (RYE) 2 November 2022, specifically 31 October 2022 and 1 November 2022. APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: • DD Form 149 (Application for Correction of Military Record) • DA Form 1380 (Record of Individual Performance of Reserve Duty Training) • Leave and Earnings Statement (LES) FACTS: 1. The applicant states, he is requesting an update to his points detail for Fiscal Year (FY) 2022 to include duties performed 31 October 2022 and 1 November 2022 as evidenced by DA Form 1380 and corresponding LES provided. The deficiency of these retirement points in his military record is withholding his ability to count FY 2022 as a good retirement year. He was told that these duties occurred during the "brown out" period while retirement point recording was transitioning to the new Integrated Personnel and Pay System – Army (IPPS-A) system. He has already submitted a request for amendment through his unit administrator, as well as a formal request through IPPS-A who advised him that any amendments needed prior to 14 November 2022 would require submission of a request through the Board. 2. A review of the applicant's official record shows the following: a. On 3 November 2011, the applicant was appointed as a Reserve commissioned officer and executed an oath of office in the Medical Corps. b. DA Form 5016 (Retirement Accounting Statement) shows for the RYE 2 November 2022, the applicant earned 33 Inactive Duty Training (IDT) points, 15 membership points, totaling 48 points creditable. c. The applicant remains in the U.S. Army Reserve. 3. The applicant provides: a. DA Form 1380 dated 1 November 2022 showing the applicant completed the following training: • 31 October 2022, hospitalist duties at the University of North Carolina for 4 hours, totaling 1 retirement point (P-1) • 1 November 2022, hospitalist duties at the University of North Carolina for 8 hours, totaling 2 retirement points (P-2) The form was endorsed by S- D- Vice President Physician Services b. LES showing the applicant completed IDT on 31 October 2022 and 1 November 2022 4. On 14 June 2023, in the processing of this case, Headquarters, U.S. Army Reserve Command (USARC), Branch Chief, provided and advisory opinion which states, USARC reviewed the applicant's documents and determined he should be awarded the points in accordance with Army Regulation (AR) 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records). The DA Form 1380 shows he performed duty for points only, but it was never updated to the DA Form 5016. Full administrative relief granted. 5. On 30 June 2023, the advisory opinion was provided to the applicant to allow for comments. He did not respond. BOARD DISCUSSION: After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The applicant’s contentions, the military record, and regulatory guidance were carefully considered. According to the submitted DA Form 1380, the applicant performed the duties. The Board was persuaded by his argument that the error occurred during the transition to the new Integrated Personnel and Pay System – Army (IPPS-A) system, and agreed with the USARC determination that the applicant should be awarded the points in accordance with AR 140-185 (Training and Retirement Point Credits and Unit Level Strength Accounting Records). The DA Form 1380 shows he performed duty for points only, but it was never updated to the DA Form 5016. The Board determined that full administrative relief should be granted. Paragraph 2-2 (Criteria for earning retirement points) states retirement points may be earned by U.S. Army Reserve Soldiers for active duty or duty in an active status for active duty for training (ADT), initial active duty for training (IADT), involuntary active duty for training (involuntary ADT), voluntary IDT, annual training (AT), IDT, membership points, and for other activities specified in this regulation. • Four-hour rule; Soldiers earn one point for each scheduled 4-hour period of IDT at Battle Assembly, Rescheduled Training (RST), Equivalent Training, or Additional Training Assemblies • Two-hour rule; Soldiers earn one point for each IDT period per day for funeral honors duty with a maximum of one point per calendar day • Four/eight-hour rule; Soldiers earn one point for each 4 hour or greater period, award of a second point in the same day requires additional hours to bring the day's total to a minimum of 8 hours for a maximum of two points in 1 calendar day • Eight-hour rule; approved electronic-based distributed learning (EBDL) courses will be awarded to members of the Selected Reserve (TPU), subject to available funding, and as pre-approved, Soldiers may earn one retirement point and be paid for one IDT for every 8 hours of distance learning completed b. Paragraph 3-3 (DA Form 1380) states nonpaid DA Forms 1380 will not be entered into Automated Drill Attendance Reporting Software (ADARS) and will be forwarded to HRC for award of retirement points no later than the end of each duty month. c. Table 3-1 provides that the code "N" will be entered for RST. The code "N" indicates the Soldier is entitled to retirement point credit only. 2. Department of Defense Instructions 1215.07 (Service Credit for Non-Regular Retirement) states inactive duty may be credited for each attendance at an inactive duty training period. A maximum of 2 retirement points for attendance at inactive duty training periods or equivalent training, in any 1 calendar day. The Service member's participation is without payment other than the pay to which the Service member is entitled as a Reserve Component member.
