Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20190010168, 12 January 2021. 2. The applicant states, in effect: a. He served in Vietnam from 4 June 1971 in a weapons infantry military occupational specialty, 11B2O. He was awarded the Sharpshooter Marksmanship Qualification Badge with Rifle Bar and Marksman Marksmanship Qualification Badge with Pistol Bar. b. He served in Vietnam Central Highlands in 1971. His last duty assignment when he returned from Vietnam was Combat Support Company, 63d Armor, 1st Division, Fort Riley. 3. The applicant provided three letters of support for his contention that he completed foreign service in Vietnam. 4. A review of the applicant's service records shows: a. On 26 January 1971, he was inducted into the Army of the United States. b. Headquarters (HQ), 1st Infantry Division (Mechanized), and Fort Riley, issued him: (1) Special Orders (SO) Number 170, 19 June 1971, assigned him to Headquarters and Headquarters Company (HHC), 63d Armor. (2) SO Number 74, 14 March 1972, assigned him Combat Support Company (Provisional), 2nd Battalion, 63d Armor, effective 28 February 1972. (3) SO Number 103, 12 April 1972, relieved him form CSC, 2nd Battalion, 63d Armor and assigned him to HHC, 2nd Battalion, 63d Armor, effective 21 April 1972. (4) SO Number 110, 19 April 1972, relieved him form HHC, 2nd Battalion, 63d Armor, and assigned him to special duty in MOS 17K2O. c. Unit Orders Number 7 issued by Combat Support Company, 2d Battalion, 63d Armor, appointed him as an acting noncommissioned officer. d. On 22 September 1972, he requested approval from his Commanding Officer, CSC, for early release under provisions of Army Regulation 635-200 (Personnel Separations -Enlisted Personnel), paragraph 5, in order to accept employment with (Company) General Contractors. e. On 5 October 1972, the Commanding General,1st Infantry Division, approved his early release under provisions of Army Regulation 635-200, paragraph 5-21, SPN 414 (Early Release for Employment). f. His DA Form 20 (Enlisted Qualification Record) shows he completed no foreign service and he completed no assignments to any units in Vietnam. g. On 26 October 1972, he was honorably released from active duty and transferred to the U.S. Army Reserve. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows he completed 1 year, 9 months, and 1 days of net service this period and no foreign service in item 22c (Foreign and/or Sea Service), and no entry in item 30 (Remarks) of dates of service in Vietnam. h. On 12 January 2021 (ABCMR Docket Number AR20190010168), the Board found no evidence of records showing he served in Vietnam. ? BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found relief is not warranted. 2. The Board found no military service records corroborating the applicant s claim that he served in Vietnam. The Board determined the available evidence is an insufficient basis for making the correction the applicant seeks. Army Regulation 15-185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army acting through the ABCMR. The ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. 2. Army Regulation 635-5 (Separation Documents), effective 1 February 1967, prescribed the separation documents that would be furnished each individual who was separated from the Army including Active Duty Training personnel and established standardized procedures for the preparation and distribution of these documents. All available records would be used as a basis for the preparation of the DD Form 214, including DA Form 20, DA Form 66, and orders. a. Enlisted Personnel. In item 22c (Foreign and/or Sea Service) Enter total active duty outside continental limits of the United States for the period covered by the DD Form 214 and the last oversea theater in which service was completed, e.g., Foreign and/or Sea Service (USAREUR)." b. In item 30 (Remarks) enter inclusive dates of service in Vietnam during current period of service. 3. Army Regulation 635-200 (Personnel Separations - Enlisted Personnel), in effect at the time, provided the authority for separation of enlisted personnel upon expiration term of service, prior to expiration term of service, retirement by reason of length of service, and issuance of discharge certificates.
