APPLICANT'S SUPPORTING DOCUMENT(S) CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * January through May 1991 Leave and Earnings Statements FACTS: 1. The applicant did not file within the 3-year time frame provided in Title 10, U.S. Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he served in Saudi Arabia during Operations Desert Shield and Desert Storm. When he submitted a disability claim, his DD Form 214 did not reflect that he served in the Gulf War. He needs this corrected. 3. Review of the applicant’s service records shows: a. He enlisted in the Regular Army on 16 February 1982. He held military occupational specialty 91C, Practical Nurse. b. He served through multiple extensions or reenlistments, in a variety of stateside or overseas assignments, including Germany from 26 September 1983 to 8 April 1988 (4 years, 6 months, and 13 days), and he attained the rank of sergeant (SGT)/E-5 c. He was last assigned to the Medical Department Activity, Fort Leavenworth, KS, beginning around October 1989. d. He was honorably discharged in the rank/grade of SGT/E-5 by reason of completion of his required service on 21 August 1991. His DD Form 214 shows he completed 9 years, 6 months, and 6 days of active service. It also shows in: * Block 12f (Foreign Service), the entry 0004-06-13 foreign service credit) * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), the: * Army Service Ribbon * Army Lapel Button * National Defense Service Medal * Overseas Service Ribbon * Army Good Conduct Medal (2nd Award) * Marksman Marksmanship Qualification Badge with Rifle Bar * Expert Field Medical Badge * Block 18 (Remarks) does not show deployment to Southwest Asia 4. His name is listed in the Operations Desert Shield/Storm Database compiled by the Defense Manpower Data Center. The database shows he was deployed in support of the Gulf War from 2 January 1991 to 19 April 1991. The primary Operations Desert Shield/Desert Storm file contains one record for each active-duty member who participated in theater between 2 August 1990 and 31 July 1991. 5. The applicant provides his Leave and Earnings Statements as follows: * January 1991, authorized overseas pay beginning on 4 January 1991 and danger pay on 1 January 1991 * February 1991, authorized overseas pay and danger pay for the month, Desert Shield * March 1991 authorized overseas pay and danger pay for the month, Desert Shield * April 1991 authorized overseas pay and danger pay for the month * May 1991, stop overseas pay effective 19 April 1991 * Note : the period from 4 January to 19 April 1991 is 3 months, 15 days 5. The applicant’s NCO Evaluation Report for the rating period December 1990 to April 1991 show she was assigned to the 109th Evacuation Hospital, APO NY (Saudi Arabia). BOARD DISCUSSION: 1. After reviewing the application, all supporting documents, and the evidence found within the military record, the Board found that relief was warranted. The Board carefully considered the applicant's record of service, documents submitted in support of the petition and executed a comprehensive and standard review based on law, policy and regulation. Upon review of the applicant’s petition and available military records, the Board determined there was sufficient evidence from the Gulf War Roster and the applicant’s pay records that supports his request and shows he served in the Persian Gulf from 2 January 1991 to 19 April 1991. The Board noted based on the applicant’s deployment he is authorized awards associated with his deployment to the Persian Gulf. 2. Furthermore, the Board determined the applicant's service record did not reflect she was awarded the Army Good Conduct Medal (AGCM) and his record shows he received "excellent" conduct and efficiency ratings throughout his service. Based on this the Board granted relief for correction of the applicant’s record annotating his deployment and awards associated with that time and award of the Army Good Conduct Medal. REFERENCES: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states: a. The Southwest Asia Service Medal is awarded to members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over, on or after 2 August 1990 to 30 November 1995. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January to 11 April 1991) * Cease-Fire Campaign (12 April 1991 to 30 November 1995) b. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-KU) was approved on 9 November 1995 and was awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993. c. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. d. The Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. 3. Army Regulation 635-5 (Separation Documents), in effect at the time, provided detailed instructions for completing separation documents, including the DD Form 214. It provided for entry of the total amount of foreign service completed during the period covered in item 12c (Net Active Service This Period) in item 12f.
