Facts and Circumstances: a. Evidence of record shows that on 19 July 1989, Orders 136-8, DA, 9th Personnel Service Company Fort Lewis, WA, discharged the applicant from the Regular Army, effective 24 July 1989. The applicant was not available to sign her DD Form 214 (Certificate of Release or Discharge From Active Duty). Her DD Form 214 indicates that she was discharged under the provisions of Chapter 14, Paragraph 14-12c, AR 635-200 by reason of misconduct with a characterization of service of under other than honorable conditions (UOHC). Furthermore, the DD Form 214 shows a Separation Code of JKQ (i.e., misconduct commission of a serious offense). The specific facts and circumstances leading to the applicant's discharge are not contained in the available records. b. On 24 July 1989, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, and 7 months of active military service and accrued 119 days of lost time. 2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The specific facts and circumstances leading to the applicant’s separation from the Army are not contained in the record. However, the applicant indicated in her application to the Board that she was discharged due to her imprisonment for vehicular homicide. She also stated that she successfully completed both her 15-month sentence and 10-year period of probation, and that she has been sober since May 1993. Considering the above facts and circumstances, and taking cognizance of the time which has elapsed since her discharge from the service, the Board determined that the applicant’s characterization of service is now inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to general, under honorable conditions.
