Evidence of record shows that on 12 October 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service. The separation authority directed that the applicant be released from active duty and transferred to the individual ready reserve with a characterization of service of general, under honorable conditions. b. On 27 October 1989, the applicant was released from active duty. At the time of release, the applicant had completed 3 years, 3 months, and 20 days of active military service. 2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The applicant’s official record shows that he was released from active duty and reassigned to the USAR Control Group because of financial and marital problems. Since his release from active duty, the applicant has served in the USAR as a disbursing officer, been promoted to the grade of sergeant/E-5, successfully completed a period of active duty for Operation Joint Endeavor, and received excellent performance evaluations. Based on the foregoing, the Board determined that the applicant’s release from active duty is now equitable. Accordingly, the Board voted to grant relief by changing the applicant’s characterization of service to fully honorable, and to change his narrative reason for discharge to Secretarial Authority.
