Evidence of record shows that on 11 January 1996, Commonwealth of Pennsylvania, Department of Military Affairs, The Adjutant General, Annville, Pennsylvania, Orders 007-113 discharged the applicant from the Army National Guard and as a reserve of the Army, effective 23 January 1996. The record contains a properly constituted NGB Form 22 (Report of Separation and Record of Service). His NGB Form 22 indicates that he was discharged under the provisions of Chapter 8, NGR 600-200 by reason of misconduct-unsatisfactory participant, with a characterization of service of under other than honorable conditions. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records. b. On 23 January 1996, the applicant was discharged. At the time of discharge, the applicant had completed 14 years, 6 months, and 8 days of active military service. 2. Legal/Regulatory Basis for Separation Action: National Guard Regulation (NGR) 600-200 and Army Regulation 135-91 govern procedures covering enlisted personnel management of the Army National Guard. Chapter 8 of NGR 600-200 covers, in pertinent part, reasons for discharge and separation of enlisted personnel from the State Army Reserve National Guard. Paragraph 8-26(q) of that regulation provides in pertinent part that individuals can be separated for being an unsatisfactory participant. Army Regulation 135-91 states that a member is an unsatisfactory participant when nine or more unexcused absences from scheduled drills occur during a 1 year period. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board found that the length and quality of the applicant’s service mitigated his misconduct. In view of the foregoing, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board also noted that the applicant’s RE code on his separation document is incorrect and has recommended that the State Adjutant General change it to RE-3. Other than the change in RE code, the Board determined that the reason for discharge was proper and equitable and voted not to change it. (1-15) The issues are rejected. The Board determined that the applicant’s misconduct diminished the quality of his service below that meriting a fully honorable discharge. 3.
