Facts, Circumstances, and Legal Basis for Separation a. Facts and Circumstances: The specific facts and circumstances leading to the applicant’s release from active duty are not contained in the available records. However, the record does contain a properly constituted DD form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. Her DD Form 214 indicates that she was released from active duty under the provisions of Chapter 5-8, AR 635-200, by reason of parenthood, with an honorable characterization of service. Further, the DD Form 214 shows a Separation Code of LDG (i.e., parenthood), with a reenty eligibility (RE) code of '3.' On 1 March 2005, Orders 060-0013, Department of the Army, Installation Management Agency, Headquarters, US Army Garrison, Fort Carson, CO 80913, released the applicant from the Regular Army, and assigned her to USAR Control Group (REINF) AR-PERSCOM, 1 Reserve Way, St. Louis, MO 63132, effective date: 7 March 2005. b. Legal Basis for Separation: Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-8 provides that a Soldier may be separated when parental obligations interfere with fullfillment of military responsibilities. Specific reasons for separation because of parenthood include inability to perform prescribed duties satisfactorily, repeated absenteeism, late for work, inability to participate in field training exercises or perform special duties such as CQ and Staff Duty NCO, and nonavailability for world assignment or deployment according to the needs of the Army. Unless reason for separation requires a specific characterization, a Soldier being separated for the convenience of the government will be awarded a characterization of service of honorable, under honorable conditions or an uncharacterized description of service if in entry level status. c. Response to Issues, Recommendation and Rationale: After a careful review of all the applicant's available military records for the period of service under review, the issue and the independent evidence she submited, the analyst found no mitigating factors that would merit a change to the applicant's narative reason. The applicant’s record is void of the complete facts and circumstances concerning the events that led to her release from the Army. However, the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant's signature. This document identifies the narrative reason and the characterization of her service, and the analyst is presuming Government regularity in the discharge process. The applicant was released from active duty for an inability to perform prescribed duties due to parenthood, under the provisions of Chapter 5-8, AR 635-200, and transferred into the US Army Reserves. Furthermore, she was properly assigned a separation code of "LDG". The analyst noted the applicant's issue, however, individuals are assigned separation codes based on the narrative reason for discharge. The analyst was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Therefore, the analyst determined that the narrative reason for separation was both proper and equitable. VII.
