Applicant Request: Upgrade Reason Change RE Code Change Issues: The applicant states, in effect, that he was told that he was a model Soldier until he began having issues with his wife (ex-wife now). His wife began having an affair, and when he refused to allow it to continue, she did everything she could to sabotage his military career. His ability to serve was severely impaired because of the many issues that her infidelity and maliciousness caused by the repeated emotional and financial problems caused by his ex’s taking money without his consent to finance her affair. He admits that he was co-dependent and put the restoration of his marriage before his military career. He was also initially granted a medical discharge by his Commanding Officer, but a change of command went into effect before he was able to finalize it. The new Commanding Officer went only on the records, which were biased in favor of his ex. Since his discharge from the military, he has been granted a divorce, is attempting to get full custody of his children, is currently pursuing a Master’s Degree, and a personal trainer’s certification. He has already earned his Radiologic Technologist certification since his discharge from the military and hopes to further that by pursuing training in Nuclear Medicine. II. Facts and Circumstances: The evidence of record shows that on 7 July 2010, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 14, paragraph 14-12c, AR 635-200, by reason of misconduct, commission of a serious offense, for willfully disobeying a commissioned officer, with a general, under honorable conditions discharge. He was advised of his rights. On 10 July 2010, the applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the Army and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed action and recommended approval of the separation with a general, under honorable conditions discharge. On 26 July 2010, the separation authority waived further rehabilitative efforts and directed the applicant’s discharge with a characterization of service of general, under honorable conditions. The record contains a military police report, number 01622-2010-MPC044 b. Legal Basis for Separation: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 14 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or being absent without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate; however, a general, under honorable conditions or an honorable discharge may be granted. c. Response to Issues, Recommendation and Rationale: After carefully examining the applicant’s record of service during the period of enlistment under review the issues and documents he submitted, the analyst determined that the discharge was both proper and equitable. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The analyst determined that the applicant’s discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By his misconduct, the applicant diminished the quality of his service below that meriting an honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The applicant contends mitigating circumstances contributed to his misconduct. Specifically, he claims family issues at home resulted in his discharge. While the applicant may believe his stress at home was the underlying cause of his misconduct, the record of evidence does not demonstrate that he sought relief from stress through his command or the numerous Army community services like the Chaplain, Army Community and Family Support Services, Community Counseling Center, and other medical resources available to all Soldiers. Likewise, he has provided no evidence that he should not be held responsible for his misconduct. The analyst noted that the applicant contends that he was initially granted a medical discharge by his Commanding Officer; however, there is no evidence of record and the applicant has submitted no probative medical evidence that he had a medical problem which rendered him disqualified for further military service and that he was not able to perform his duties, with either medical limitation or medication. The analyst acknowledges the applicant's successful transition to civilian life and noted the many accomplishments outlined with the application. However, in review of the applicant’s entire service record, the analyst found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. Therefore, the analyst concluded the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief. VII.
