REGULATORY CITATION(S): National Guard Regulation (NGR) 600-200, govern procedures covering enlisted personnel of the Army National Guard. Chapter 6 of NGR 600-200, covers in pertinent part, reasons for discharge and separation of enlisted personnel from the State Army National Guard. Paragraph 6-35l(8) of that regulation provides in pertinent part that individuals can be separated that are medically unfit for retention per AR 40-501. Commanders, who suspect that a Soldier may not be medically qualified for retention, will direct the Soldier to report for a complete medical examination per AR 40-501. AR 600-200, Table 6-1, Definition of Reentry Eligibility Codes shows that a Soldier separated for being medically unfit for retention will be assigned an RE Code of 3. 8. DISCUSSION OF FACT(S): The applicant requests a change to his reentry eligibility (RE) code. The applicant's available record of service, the issues and documents submitted with his application were carefully reviewed. The applicant requests a change to his RE code; the record of evidence shows was discharged under provisions of National Guard Regulation (NGR) 600-200, paragraph 6-35l(8), by reason of being medically unfit for retention per AR 40-501. AR 600-200, Table 6-1, Definition of Reentry Eligibility Codes shows that a Soldier separated for being medically unfit for retention will be assigned an RE Code of 3. The applicant seeks relief contending, he was a strong Soldier and did his job with no complaints. The applicant's service accomplishments and the quality of his were carefully considered. The applicant further contends, his RE code was improper because it has limited him from joining another branch of the military; and he desires a second chance to finish his career in the military. Soldiers being processed for separation are assigned reentry codes based on their reason for discharge. Based on AR 600-200, Table 6-1, the applicant was appropriately assigned an RE code of 3. There was no basis to grant a change to the reason or to the RE code. An RE Code of 3 indicates the applicant requires a waiver prior to being allowed to reenlist. If reenlistment is desired, the applicant should contact a local recruiter to determine eligibility to reenlist. Recruiters can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of reentry eligibility (RE) codes if appropriate. The discharge was consistent with the procedural and substantive requirements of the regulation, was within the discretion of the separation authority, and the applicant was provided full administrative due process. 9.
