REQUEST, ISSUES, BOARD TYPE, AND DECISION: The applicant requests an upgrade of her uncharacterized discharge to honorable or general (under honorable conditions). The applicant seeks relief contending, in effect, her childhood dream was to be a Soldier, defend the constitution and give back to the country that had given to her. She enlisted in the Army and was injured in the line of duty while at basic training. Although injured, she did not give up and she was very hopeful that the pain would go away. She was diagnosed with medial tibia hot splints and pelvic stress fracture. She used crutches for weeks and the military hospital doctor recommended that the applicant be medically discharged. She states, she has been separated from the military over 6 months, but the physical pain is still there. She is unable to go back to her job because she cannot lift heavy equipment or stand for long periods of time. She is in her 20s and she still has a long life ahead of her, but the most hurtful part is during the job application process and the interviews when she reveals her discharge is not honorable. She is hopeful that an upgrade would help her in her civilian life. She desires to get back to her normal civilian life, where she can continuing working. She states, although she could not complete her military contract due to her injury, she still lives with the Army values and she will try to contribute to society through volunteering and community service. Disciplinary Action(s) / Evidentiary Record: Memorandum for record, dated 9 May 2016, reflects the applicant was evaluated by a Physical Therapist for pain in her groin. A bone scan reported that the applicant had an early stress fracture in her left pelvis bone. The injury occurred very early in her training and was indicative of an individual whose bone structure was not likely ready to endure the physical demands of Army BCT. Despite profiles, medications and the use of crutches, she still continues to have pain in her groin. The applicant was offered WTRP and convalescent leave and she refused both of the options. The recommendation was that the chain of command consider her for discharge under AR 635-200, Chapter 5-17. i. Lost Time / Mode of Return: None j. Diagnosed PTSD / TBI / Behavioral Health: None 5. REGULATORY CITATION(S): Army Regulation (AR) 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-17 specifically provides that a Soldier may be separated for other physical or mental conditions not amounting to a disability, which interferes with assignment to or performance of duty and requires that the diagnosis be so severe that the Soldier's ability to function in the military environment is significantly impaired. AR 635-200, paragraph 5-1, states that a Soldier being separated under this paragraph will be awarded a characterization of service of honorable, general (under honorable conditions), or an uncharacterized description of service if in entry-level status. A general (under honorable conditions) discharge is normally inappropriate for individuals separated under the provisions of Chapter 5-17 unless properly notified of the specific factors in the service that warrant such characterization. 8. DISCUSSION OF FACT(S): The applicant requests an upgrade of her uncharacterized discharge to honorable or general (under honorable conditions). The applicant's record of service, the issues and documents submitted with her application were carefully reviewed. The record confirms that the applicant's discharge was appropriate because the quality of her service was not consistent with the Army's standards for acceptable performance of duty by military personnel. The evidence of record shows the applicant, while in training status, was evaluated by competent medical authority and determined the applicant had a an early stress fracture in her left pelvis bone. It was determined these injuries would prevent her from completing training. The applicant's service was uncharacterized because she was in entry-level status and there are no unusual circumstances present in the applicant's record and her service did not warrant an honorable discharge. An uncharacterized discharge is neither positive nor negative and it is not meant to be a negative reflection of a Soldier's military service. It merely means that the Soldier has not been in the Army long enough for her character of service to be rated as honorable or otherwise. The record does not contain any evidence of arbitrary or capricious actions by the command and it appears that all requirements of law and regulation were met and the applicant's rights were fully protected throughout the separation process. The applicant contends that an upgrade of her discharge will allow her to obtain better employment. However, the Board does not grant relief for the purpose of gaining employment or enhancing employment opportunities. The discharge was consistent with the procedural and substantive requirements of the regulation, was within the discretion of the separation authority, and the applicant was provided full administrative due process. 9.
